Well me and the other half are absolutely livid (as you've probably gathered from the heading)

We ordered a new caravan in December which was due for delivery in March, we paid our deposit (£1000) and awaited news from our dealer of any developments. January came and went and in the middle of February the OH decided to ring the dealer to price up a motor mover for our pending arrival and give the dealer our mobile numbers-salesman gave him the price and said he would be in touch as soon as he knew anything regarding the delivery date.

Last Monday the OH called the dealer again to ask if there was any news regarding the delivery date, he was met with the response of 'well i don't know if it has been ordered from the manufacturer or another dealer?' so salesman said he would call back on Tuesday.
Well we were astounded that the salesman didn't seem to have a computer or clerical record of where our caravan that was ordered 3 months earlier was coming from!!!!

Anyway Tuesday arrived but no phone call-so OH called again to see what was happening-all of a sudden the salesman gave us a delivery date of 23rd June-alarm bells started ringing and we were thinking that the caravan hadn't been ordered. OH said that this was unacceptable-we had had no contact whatsover from the dealer except calls we had made and were never informed of any problems or delays with our van. Salesman said we could have another van they had in stock (nothing we wanted), wait till the delivery date (we go away 26th June so if the van was on time chances are it wouldn't be ready), he would try and source another van or we cancel.   

Couple of days later the salesman rang to say he could get us a van in April-but it would be £950 more than what we had originally ordered!!! (not an option) so we rejected that, rang back again saying he would leave a message with a colleague to ring us regarding anything else he could do. You won't be surprised the call never came so OH called AGAIN to cancel the order. When he rang the other salesman had no knowledge at all about our problem, agreed we had been messed about and said if we wanted to cancel to put it in writing. We realised there was a good chance we would lose our deposit but we didn't care as it was just becoming ridiculous-we were going to spend thousands of pounds and they didn't care less! So i sent a letter on Saturday asking to cancel-explaining why and also stating they couldn't keep their part of the contract.

Well!! Today OH gets a call from Sales Manager saying he had our letter but now he could get us the caravan we wanted for EASTER!!!! OH told him we weren't interested and still wanted to cancel, to which he replied that they had fulfilled their part of the contract, kept us informed and we would have to pay another £695 to cancel!!! or buy the caravan.
How can he say the contract has been fulfilled when we told them by phone Friday we were cancelling and by letter which they will have received yesterday-at this time they could nothing and couldn't get a van!

As you may have gathered-we are both so angry we could burst!!!

Shoddy dealer in my eyes, there`s no way I would hand over £1,000 deposit without a written delivery date and the option of a full refund if delivery date could not be met.

Sorry to hear your tale of woe, it sound awful. Hopefully one of the legal experts like Phil will be on soon to give you some proeper advice. As a matter of interest, what make is the van?

Whilst I can see that you are not happy (I wouldn't be either) I think you may be cutting of your nose to spite your face. They have not dealt with your problem well but I rather think they may be reading their small print on the order form.

You have paid them a deposit of £1000 which I presume you will lose. I certainly wouldn't pay another £695 on top. That is just a frightener!

You need to weigh up a) what you will lose and b) what you will gain by getting the van you ordered.

If it were me, I would contact the manufacturers tomorrow and make enquiries as to what happened to your order, was it placed or are they trying to pull the wool over your eyes?

I presume that the dealers are not main dealers as they wouldn't dare treat a customer in this manner. Would they bear the same name as the place where you live?

Be carefull, as pride often comes before a fall!

I feel your anger and I would be just the same.

The unfortunate thing is if you do go ahead with this van they are offering (which seems the easier option for you to get what you are after) you will have to take it back to them for any warranty issues. If it were me I wouldn't want to touch them with a barge pole after this.

Remember though if you do go ahead with this purchase you don't have to take it back there, to be serviced, as long as it's done by an approved ccaravan council engineer/workshop your warranty still stands. however af there are any future warranty issues as I said you will have to take it back there.

By the way not sure of other manufacturers but with Bailey you can contact them to see when or if it was ordered and when it is going to be made.

Hope you get the resolve you are looking for.

Hi. No expert, but surely they've failed to fulfil their side of the contract, to get you the caravan you ordered, by March. On your side you paid your deposit as requested.
I would write again, recorded delivery, to the MD or whatever of the dealership pointing this out and give them 14 days to hand your deposit back, along with interest at the current rate, and all the costs for your phone calls. If not, straight to the Small Claims Court citing their failure to fulfil their contract as your reason. It is an amount which they could handle, and most of it can be done online.
If you get a judgement in your favour and they don't pay up, send in the bailiffs to seize their goods for auction.

I tend to agree with johnks. I think I would agree to take delivery for Easter, and then you have the van you originally wanted. There is no way I would loose my deposit and pay a further £695 extra. BUT I would certainly look for another caravan dealer for servicing etc. and I would probably name and shame the dealer you have had such shoddy treatment from.

Understand how you feel but as has been said "don't cut off your nose to spite your face" by rejecting the van offered in April. If it was me I would get it in writing, get the van in april then shout at them and the manufacturer and get it serviced elsewhere or you may finish up with no van & no deposit. Possibly a further claim from them for breach of contract.

sorry to hear of your problem i actually sell caravans and there has been unfortunatley delays in some models some by more than two months this of course has caused many problems and angry customers! however please read your invoice because ours state we can not be responsible for delays in given due dates we also state ours as estimated. This is both anoying to the dealer to but we try to offer alternative dates or let the customer cancel if the van is serverly late! more of a jesture but a dealer may by law push for payment of the van but we feel this is not really nessesary.To  be asked for £950 more to me is strange i can only think of a possible vat increase but still find this strange.As with saying written due date and full refund i think you would find it hard to find many if not any to agree to that, delays can be down to weather/parts and often unavoidable I do  hope you can sort your van and next time hopefully find a dealer who will help you and look after you better

They originally promised you delivery by March, now after a fair bit of confusion they have assured you they will just about fulfill that. Good Friday is April 2. Its what you wanted so I suggest you go with that. Perhaps get a written assurance that they will deliver the caravan for you to go away at Easter or return your deposit.

It seems a bit daft to get involved in litigation when they appear to be promising the caravan you wanted, more or less when you wanted it.

I understand your anger but id just go for it now , its easier all round , but I wouldnt use the dealer for servicing or anything else in future.

yet another example of big amounts of money paid out for caravans and the seller not giving a damn ......

It sounds like a cockup in't sales depts. Don't mean theres owt wrong with the service dept, if you want the caravan I'd make your peace with them.

Sorry no info here either....and yes that is a quick delivery!!
We ordered a Coachman Pastiche 460 in December and every place we rang gave us a delivery date of May or June....we only managed to get a delivery date of March by ordering from a dealer that is only starting to sell Coachmans this year! They haven't even had their initial stock yet.

Hope you manage to get some info from somebody on here before you take delivery.

From seeing this post I imagine the dealer has had 'teething problems' with the Coachman dealership. As previously said, I would go for the Easter delivery.

Hi All

Thanks for all your advice. OH is going to ring Coachman up tomorrow to see if they can tell us if our original order was actually placed or not.

I have read the small print on the invoice (several times) and it states that if the dealer cannot provide the caravan within 28 days of the estimated delivery time a customer can cancel-this was the situation when we decided to cancel on Friday. We aren't so naive to not expect any delays-but then all of a sudden when we pushed for a date it was 3 months off i really don't think that's right.

The Sales Manager who spoke to OH more or less called him a liar, saying everything we told him was untrue! I know people think we should accept the van that has been offered by Easter, but i wonder if its just another pipe dream and i don't think a van will materialise, also we are really loathe to hand over our hard earned cash to this dealer.

It doesn't help that while we were out on the prowl at the weekend we were came across a show van from the NEC that was at a bargain price and would still be a bargain if we lost the £1000 deposit (which is what we were expecting)

Why is everything such a chore?

if it was me and mad as you are,understandably, please do not lose a £1000.just think how long it takes to earn that money.i would swallow my pride and take the new van at Easter.but the added monies of £950 just say no we have a contract for a set price.just my opinion mind.

Oh my god, Reading your post is like you've wrote it for us!!!!!
We are having similar problems. We ordered our caravan in October at the nec show and told to expect it early feb. Not wanting to pester we left it til inbetween christamas and new year to call into the dealers for our first update. We were told to expect it any day!!! Yipeeeeee.....

Well we waited and waited...... And rang them the second week in January to see where it was, they then said it would be as advised first and be early feb!!
We chased them til we felt like we were pestering and was eventually told the caravan build date was 29th march and to expect it early April!!!! Hhhmmmmmm, the air was blue, we were not impressed. Up to now we have had to cancel 3 holidays we booked. I know what people think.."why book if you haven't got the caravan?' but if you don't book caravan club pitches as soon as you can you've no chance.
Well we decided to get our deposit back and go elsewhere, rang around dealers to try to order ( before approaching our dealer for refund) and they all wanted more money because of VAT increase and was told we wouldn't get a new van til at least end of June. Which would be 8 months from ordering!!

So, back to our dealer......on the back of our order firm it states if the dealer can't make within 4 weeks of the estimate delivery date then the buyer can cancel and deposit will be refunded in full. We stated they had broke the terms and wanted a refund of our deposit. He said he'd check and ring us back. Well he rang back and said he'd got a van we could have that weekend but it was a display model and would be the sane price we were paying.!!! We declined this offer.

I've rang bailey that confirms the dealer ordered it correctly and the build date has never changed, but confirmed that ours is 'priority' and would be the first out for delivery, so we've decided to wait as we're nearly at he delivery date (6 months since we ordered!).


My only concern is now that I'll not actually 'love' the van once it comes as we've had a stressful nightmare getting it. OH is not convinced and thinks once it's here we'll be so excited we'll forget wots gone on in the run up to getting it.


The person who posted that you wouldn't part with your well earned cash until there was an expected delivery date, no dealer who sell brand new vans give a definate delivery date because the manufacturers can't guarantee one, they give you a build date but this could change due to unforseen circumstances.




I hope you get it sorted soon. It'll be worth it when your sat outside your new caravan in the sunshine!!!!!
