We have just purchased a new Triganno Odyssee. After putting it up for the 2nd weekend a split in the seams has appeared in the corner. I have rung the dealer and they have said we could post the canvas back for repair. Does anyone know my consumer rights? I am not really comfortable with a repair (surely this is far too early for a fault in the seams). Also taking the canvas off seems quite a job. We live a long way from the dealer.

Provided you did not cause the damage yourself:
You have a statutory right to expect that goods will be of satisfactory quality - clearly fails on this one especially if fault not pointed out to you at time of sale.
You have a statutory right to goods that are fit for purpose - clearly fails on this one too - split seams causing leaks.
It looks like your statutory rights have been breached.
Your dispute is with the trader from whom you bought your unit.
If the goods are not of satisfactory quality, but only contain a "minor defect", you can only reject the goods if a "reasonable person" would consider the defect to make the goods as a whole unsatisfactory. Depends here whether you think the defect is severe enough to affect the whole unit - non water-tight!
If you bought your unit less than 6 months ago and your rights have been breached, it can be assumed the problem will have existed on the date of purchase/delivery - unless the trader can show there was no defect on day of delivery.
If you had a guarantee with your unit, check the details to see what options you have for making a claim for a replacement.
How you paid for the unit also has a large bearing on how your rights are affected.
Trader is quite within his rights to offer a repair.
From what you say, it may be that you are entitled to a replacement. You will have to negotiate with the trader.
If you do not get a satisfactory resolution, it is better for you to go to your local Citizen Advice Bureau who will be able to give a complete picture of your statutory consumer rights. If you do go to CAB remember to take all documentation and receipts along with you as they help identify your full rights.

It was bought on a debit card.
We have been tent camping for over 20 years and even our cheap tents never split - even in gales. Is it "normal" for these seams to go? We were really enjoying our first dabble with trailer tenting, but this has really soured it. Are they this delicate? We didn't even have that bad weather. I think the CAB is a good idea.
if you bought it on a debit card it should be a visa debit ,and therefore will probably be covered by them .get in touch with them ,try your bank first .
i'm affraid this can happen,when you think how much stiching there is on this things it is bound to happen.i know this does not help you.
as said above they are intitled to offer a repair,and to be fair it is only the stiching that needs doing.are they offering to have the canvas picked up?if not i would be insisting on this.
i suppose your only over choice would be to return the unit to them,but they can still just take the canvas off and restich.so you would have to go and collect again.
I did a search the on here the other night, after I saw the Odyssee for a really good price on Ebay, but after reading the complaints bout the stitching its put me off.

Visa Debit is not covered by the same guarantee as Credit Cards. They are essentially the same as if you'd paid by cheque.
They are asking us to take the canvas off and send it to them. But I'm not happy with that, I should imagine it's quite a struggle and I don't have much room at home to do it.
I'm afraid that one way or another you will have to get it back to them, they can't really do anything otherwise. I don't think taking the canvas off is that hard, assuming you have room to erect the tent, but I would have thought it will be heavy, are they going to cover the cost of a courier?
Our Jametic had to go back 3 times for problems with the kitchen, its a real nuisance, I'm just glad we live close to the dealer.
hi same trailer tent same problem! first outing and after 3 days noticed a seam coming apart on back corner. had to tow it back to dealer in manchester where they re stitched all the corners. long journey to dealer but they were very helpful. i am very nervous putting this tent up since and worry about seams. also dreadful to errect in any wind. bent pole recently trying to lift canopy over. thank goodness hubby able to fix it otherwise we would of have to travel home.

Using a debit card is in fact the same as using CASH!
You have reduced rights for using debit card over credit card.
So long as faulty goods cost more than £100 on debit card, refund is required and trader is not playing ball, purchaser can go to bank and seek refund through them. This is known as a "chargeback" under equal liability rules.
This is not an automatic right and depends upon the policy of the purchaser's card provider. There may also be a time limit involved for making claim - Visa chargeback scheme requires purchaser to contact card provider within 120 days.
This is not as easy when trying to get refund having used a credit card - hence paying by credit card is always the better option!
