Can anyone explain the legalities or not of the following situation.

I've been looking at buying a second hand trailer tent, which according to google has a unladen weight of 375kg and a max weight of 750Kg.

My car (in the handbook) has a maximum unbraked towing weight of 720Kg, also 50% of the kerbweight would be 685kg. Internet searches have dragged up quite a bit of contradictory information.

Either, I'd be fine to tow the trailer as long as it's weight didn't exceed 50% of the cars Kerbweight or the maximum for the car or 750kg which ever is the lowest. Or because the trailer is plated at 750Kg it would be illegal to tow even if it did weigh under 685Kg.

Can anyone out there clarify this?

The maximum weight an unbraked trailer can have is 750kg. If it weighs 751kg, or more, then it has to be braked. As yours has a max weight of 750kg, and, based on the wording of the question, I'm taking it as read that it is unbraked.

Your basic question, reading between the lines is; do I use actual weight, or plated weight? If it is plated weight, then, as you quite rightly point out, you would, automatically, be illegal.

The law can be very confusing here, and Google etc don't help. The reality, however, is, actually, very simple.

If we are deciding what we are able to tow on our driving licences (particularly if we passed after 1 January 1997) then we must work on PLATED weights, in determining whether, or not, our combination is below the maximum 3,500kg allowed, on a standard B licence.

If, on the other hand (as is the case here) we are looking at legal towing weights for a vehicle, then we work on ACTUAL weights. Therefore, in this example, you first assumption is correct; as long as the actual weight of the trailer does not exceed (taking your figures as correct) 685kg, then you are perfectly legal, even though the plated weight of the trailer is in excess of this.
