If you haven't already done so, you need to get some proper legal advice on this...at  least to see where you stand.

Forums are great but for serious stuff like this, that has been going on for months,you need proper, "qualified"   advice.

I am taking legal advice since the dealer has advised me they will eventually fix the vehicle but any claims I have to make personally with fiat direct and gave me there phone number !

They claim the delays are getting the parts from Italy and the ferry strikes!

Unsure on the swift part of the vw I guess they expect me to just accept it takes months to supply parts for there new vehicles !

Reject the vehicle as it is clearly unfit for purpose - I would not accept a new gearbox in a brand new vehicle. Unless they offer serious amounts of compensation I would not entertain keeping the vehicle. Do not allow the dealer to fob you off.

I know how you feel, we just bought a Talbot express off Ebay said in good condition, on the way home smell of burning oil or clutch not sure which but made me feel really ill.
Yes you guessed right bloke we bought it from does not want to know, so now it looks like it's going to cost a lot of money. Should have known better than to trust someone on ebay but you think people are genuine.

Still no van! They advised us yesterday they had now got the part. Nothing today. Guess we need to chase them again tomorrow.

They seem to feel we can't reject the vehicle. It's a month now and summer nearly over

As others have said - put it in writing to the dealer a letter rejecting the vehicle and request politely your money back in full. If they refuse to accept your rejection, then go to the County Court and speak to the clerks who will advise you what paper work to complete and pay the fee. The dealer will be sent details of your action, and a date will be set by the court to which either they have to attend or they settle your claim. Failure to attend means automatic judgement in your favour. Then they have to pay up, and if they don't - well then you just escalate the claim to the High Court - cost £60.00, then the Sheriffs of the High Court (now known as High Court Enforcement Officers) will attend without giving any notice that they are coming. Then the defendant either pays up or the sheriff's will seize goods and take them away to be auctioned - at which point in 99% of cases the dealer suddenly pays up.

It doesn't matter what vehicle or goods you buy - your contract is with them and them alone not the manufacturer - the dealer claims back the cost of repairs etc from the manufacturer. The manufacturer will rightly refuse to deal with you telling you to see the dealer.
