An insurer will reduce NCD entitlement purely for one reason, if a claim is made on the policy for which no recovery can be made. The entitlement is sometime reinstated if the recovery could only have been made against the MIB but cannot be made due to the rules disbarring insurer claims. it will depend on two factors.
a) if the claim would have succeeded against the other party if they had been insured (in their opinion not yours!) b) the policy of the insurer (read generous nature here!)
By and large a modern composite big insurer should allow the NCD. Some of the smaller outfits and syndicates may not. I would expect the FOS to uphold a complaint against any subscribing member who failed to do so.
