Once upon a time in the civil service a chap booked sick for perfectly legitimate reasons. He was signed off by the doctor for a couple of months during which he took a holiday in spain.
On his return to work he was summarily dismissed for skiving off on holiday while he was on the sick as employer held this was a breach of contract.
At tribunal he was re-instated on the grounds that he had been certified unfit for work and was convalescing. Tribunal held that it was not the employers concern where the employee chose to convalesce.
My wife works for a small company, so no HR presonnel. Whenever she has any HR related issues she calls ACAS who provide an excellent advice line service FOC.
Thank you so much to those of you who've read this and replied to me
I've worked for the same employer for over 15yrs and they are a big organisation but HR is centralised so no local HR presence.
I am however in the union and think I may get some additional advice from one of the reps. I'm also thinking I may ask them to accompany me to any subsequent meetings so I can be properly represented.

The 2 days that I already had booked off and pre agreed as annual leave have now been treated as exactly that and NOT sick leave!
I am however very close to nearing my "acceptable level" of days sick in a 12 month period. So, I just need the good health fairy to pay me a visit now

can't do a link, i had a day booked but was off sick when it came along, got my day back.
the problem lies when your on the edge of having too many sick days and getting a disciplinary hearing!
Sometime it can work out better to offer to use up some holiday to avoid a hearing.
Some people where I work see having 20 days of paid sick as a holiday extension.
Luckily in all my working life (15 years) i've only had 10 days off sick, 8 for a operation and 2 when I cut my finger off.
I know this post is out of date and past but still thought i would comment.
where i used to work if you were off sick on Fridy and returned to work on Monday it counted as 3 days sick
did not help your sick record counting it as 3 sick days.
If you are worried about your sick record ask your doctor for a sick note even if you have to pay for it, it will show your employer that you were not just taking a day off.
My Bradford score was horrendous this year, well over the limit. Had to talk to,an occupational health nurse who ascertained it was two long breaks and one half dy sick when they sent me home and not "persistent" absences so no fall out other than it's on my record that this was an unlucky 12 months.
Just had to have a week off fr a minor op, so it won e going down again for another 12 months
