Yes, I heard that on the news the other day. It seems as if his argument is that the £xx (whatever it is) is disproportionate to the operator's costs.

Whereas, they'd be better arguing the £xx is just the the price to park. But under 2 hours, and it's waived.

Be interesting to see how it pans out.

We get 4 and a half hours at our local shopping complex. Got a restaurant, coffee shop, boots, iceland, and a couple of £1 shops and supermarket. Ooh and a pet shop

Should give enough time for a change.

I have been taken to a small claims court by PE. My case was last week - the decision was 'stayed' (postponed) pending this appeal case.

It will now probably be stayed for longer! There is a similar case about commercial penalties in July and they may be heard together, otherwise it may be 12-18 months.

we got caught out by parking eye also with an aldi store we were 15 mins over our time ,,,,,,we contact aldi and we explained we had a blue badge they took our badge number and said were not to pay the fine they will sort it with parking eye as apparantley blue badge holders are allowed 3 hrs

I dare say that round about now your Court will have been advised of the Beavis case and that ParkingEye will have asked for directions as to how your case should proceed to appeal.

Who is paying for this? Surely not the private individual concerned? I guess you need an expensive brief for a Supreme court appeal.

Barry Beavis has set up an online donations page. He raised enough in less than 24 hours to pay the £6,000 fee to Court for the next stage.

Donations are still being accepted as further payments are required once the case is accepted.

For any of you familar with the Consumer Protection (Amendment) Regulations 2014 ParkingEye's claims for those who parked before October 2014, but for which ParkingEye want you to pay after October 2014 on the basis of the Beavis decision, are prohibited by law.

Why should any one pay their excessive charges which are higher than a council? They do not own the land and do not maintain the land. In addition, shouldn't all their invoices have a VAT number as surely they earn over the threshold? I can see HMRC being very interested in this case as they can back date VAT to day one and also fine the company a huge amount of money. BTW isn't PE owned by Capita?

It would seem that HMRC would not be interested. Whilst parking charges may be subject to VAT, the charges for exceeding the time limits are not - see http://forums.pepipoo.com/lofiversion/index.php/t76936.html
