Hi all
Just need helpful advise. Brothers Ex-girlfriend took finance out to get him a car, they broke up and he has been paying it off. However, the car is in his name can she still put a repo order out to collect the car? They do not have anything in writing can she still do that?
Any help would be good as he uses his car for his work.

I'd get legal advice, its a complex situation really,
is it a HP on the car, or a loan, if the former, the HP company own the car anyway, so AFAIK no one else can repo it, as its not theirs to repo.

As long as he can prove he has been making payments for said vehicle, I would think then it it rightfully his, it may take a bit of a battle to prove this though.

If her name is on the finance agreement, yes, she can do it. Being the registered keeper with the DVLA does not indicate ownership of the vehicle.

He is the one that is paying the finance, well if she takes his car and it is legal nothing else he can do but go for his own finance (and hope that he gets it).

I would think that as long as the repayments are being made the finance company will not be aware that anything has changed especially as the car is in his name.

Be very careful because if she was fronting for him it could be fraud. If the car is in his name and she tried to repo it, she may have a hard time especially if he can prove that he has made all payments. At the moment the legal owner of the car is the finance company and if they find out it has been fronted, they can cancel and repossess. Solicitor is the way to go even if it costs money. Can't he get a loan to pay off the car?

Very interesting
Nope we have been trying he had a crash in his first car that he got finance on and they told him no for next car this is why she took out the finance. Now he keeps getting turned down for finance he is only 23 and not had much credit so not a lot of credit history that doesn't help.
So cheers for all you help will let him know.

Interesting, I was not aware of this, we have had 2 cars, bought from different dealers in the past where they organised the finance, in (at the time) my girlfriends name, when she couldn't drive, so in effect my car, with no issues at all, it was their suggestion.
First time I couldn't get credit, second time, she got a better deal than me.
