The disclosure is still in the UK. The US have no direct access to it, all they can do is request information from the UK authourities if they are suspicious of somebody. A normal well funded tourist with a return ticket who looks ok is unlikely to be stopped & grilled.

I totally agree with you..it was 35 yrs ago, how long have you to pay for a minor crime!

True story coming up;
In 1976 a man appeared before a Crown Court in the north of England. He had been found guilty after a trial of theft of metal. He was born in Newcastle on a certain date. After this mans previous convictions were read out to the Court. He contested the convictions and a young Police Officer was given the task of sorting them out.
It transpired that on the same day as this guilty man was born, there were two further births, one in Sunderland and one in Durham and all three babies were given the same name.
Not only that but some time later at or about the same time, all three by now young men committed offences in the same area and that's where and when their records were tangled into a real web.
It took four hours to sort out the mess.
If I was the the OP's mate and if asked, I'd deny the connection. (Unless of course the name was so unique as to make it obvious)
Now, I'm not going to tell the OP's mate what to do but all I can say is that the authorities in the USA, smart as they may be are not looking to refuse entry to a 50 something working man who is with his wife and friends.
They haven't got that much info on their files and they are looking for a different species, usually someone daft enough to put his or her own head on the block.

The US have more things to worry about, than a minor offence, which happened so long ago. They are in the here and now.

I'd say that there's no problem with this trip - I never heard of anyone being refused entry for something like that. But hey, it might still be a good idea to call the authorities just to be sure.

The simple choices are, not having read all the replies - to lie on ESTA application or to approach for a VISA because he can't answer all questions on ESTA "correctly"
