she's not going to go for job seekers as she gets her pension having carried on working, so will retire, will be sending the gov form off as soon as we get the address of the admin company ( recievers.) in the form it states that she can claim for the 12 weeks notice she should have had.

one of the directors is trying to buy it back and is seeing solictors over wifes dismissal ( redundancy) have looked on the gov insolvency agency guidelines and it seems they have broken some rules(laws). so we have a case for unfair dismissal. will take time to sort out.

If the company is going insolvent who will make the payment for unfair dismissal ?

just an update going to see the lawyers this week, in reply to bobsbabes, how you get the compensation is once the place is sold then any moneys left after the grabbing banks is used to pay the claims, without any mention of the company it is still being operated and is full every night and functions are still taking place. even the old directors have said its making money but the banks charge 65p in the pound intrest on the loan, have heard there maybe a couple of buyers sniffing around.

Redundancy money isn't taxableP pay in lieu of notice generally is.
I am in the middle of being made redundant too, so can imagine how she feels - particularly when it is all so sudden.

Its best to go straight to the Insolvency office;for the best info.   You should apply for a protective award if you were not consulted. Beware of the Tax people making mistakes.   I have been a volunteer on redundancy site for a large firm that closed in 2008 and we are still trying to sort it out. The system has changed last year so now you can only apply for a small part as previously and there is a charge.    Ahnd be careful if you dont claim JSA as it is deducted from your Pay In Lieu of Notice. even if you dont receive it..(nobody ever beleives that one but they scream when they find out)
