Its a daft discussion because the same argument can be used both ways

I would say that any responsible caravaner with suitable car with towing limit above there vans MTPLM would on occasion weigh there van on a weighbridge as I do .
My van is plated for 1.5 tons my car is 1748kg kerbweight and a 2 ton towing capacity so a good margin between Towing max and caravan max however we still weigh at the local weigbridge before leaving on any long trip as do not want to exceed the caravans MTPLM

If I'm understanding correctly, the general concensus seems to be that towing over the manufactures maximum car towing weight would probably be O.K if the GTW wasn't exceeded, (if the outfit is weighed by the the boys in blue, following an incident).

If it were over the GTW, then all you are likely to get is a fine and a few points on your licence, which isn't too big a deal.

What to me is more relevant, is if an accident occurs, whether it's your, or another drivers fault, I'll bet a pound to a penny that your car and caravan insurance will be made invalid by your insurance companies, and if a third party suffers a serious injury or death, then you could face a civil action to claim compensation from your estate. This would be a bad thing, and could render you homeless and penniless. Personally, I don't think it's worth the risk.

I've had to buy a lighter caravan than the one I wanted, just to stay within the maximum towing weight of car and plated MTPLM weight of caravan.

I wouldn't want to get points on my licence or a fine , had a clean licence for a long time and intend to keep it that way

Then the insurer decides that exceeding the towing capacity is a reason to deny you being insured so you could end up with 6 points and possibly the vehicle etc being seized !!

To correct you on this. If you breach the terms of your insurance as described then while you would recieve nothing for you own damaged car, the 3rd party element would remain intact allowing any injured 3rd person/property to be compensated from your insurance.

I'm also wondering if insurance assessors are a quite as dilligent as made out. After an accident car & caravan may well be recovered separately to different places & would be looked at by separate assessors, one from car insurer & one from caravan insurer. Would they even make the connection between the 2? Probably not.
