Hey all

Just returned from a lovely 2 week trip from St Ives to find a charge notice from CP Plus (in my wife's names as she is the owner of our vehicle even tho I was driving)
It's recorded that we arrived at 02:44 and left at 06:20 as it was dark I didn't see any notice to pay as there was over 50 caravans all parked up with the feet down all asleep, we didn't sleep we actually used the services and returned to our vehicle and as my daughter has disabilities we wanted to settle her in the car before we set off again.
Has this happened to anyone before??

What the next steps?? Pay or appeal??

If you mean you were parked at motorway services, you have a 2hr limit for free parking & you will have been recorded on camera arriving & leaving. All services charge for parking over 2hrs. As it is private land you do not legally have to pay it so if you don't pay it will be the companies' choice if they take the matter to a small claims court, sell debt on to a recovery agency or don't pursue it further. The 'charge notice' is in fact just an invoice.

I'd google cp plus & read the threads on forums like MSE about them, it does appear that if you ignore all their increasingly threatening letters they give up eventually. If you search you will find 'template letters' you can write to these companies stating why you believe their invoice is unenforcable.

But of course you did actually park for over 2hrs so theres no appeal, so pay/ignore/or write stating you have no intention of paying.

Private parking notice then IGNORE....

You dont have to pay BUT they will send threats saying it will affect your credit rating and they may take you to court etc etc.

Just file the letters away and keep ignoring them. Unlikely but if you do get a court letter. Check with the actual court because its not unknown to send fake ones.

Just toothless threats.

I have 2 of these notices from a different company and have not paid either of them , still getting letters but ignoring them as I was not driving the car but am the registered keeper there is no obligation on you to inform the company who was driving the vehicle it is an .invoice not a fine (these can only be issued by local authorities/police) and is sent to the registered keeper, any ''contract'' as stated on the PCN  entered into is with the driver  only, who is  not neccessarily the reg keeper.

Suggest you do not pay, much info on the net, just google PCN, do not keep writing back to them, suggest you write once stating you were not the driver and ignore all follow uo letters

I don't really understand the advice given so far. You parked somewhere that charges, you've recieved an invoice, so on what grounds would you not pay?

I could understand if this was opportunistic but what is wrong with paying the bill the company have rightfully sent you. The company pay for the land, provide facilities, taxes, have employees and give this facility free for 2 hours. Ok so it's a company and not your mother you owe the money to but because you didn't pay at the time, they have to send an invoice, then reminders, all of this costs. Imagine if no-one paid on your local bus or just paid for half their journey, would you expect the drivers to turn up for free.

I'm sorry but it's dishonest not to pay for something you have admitted you used and those that encourage you should think how that attitude might effect their employment if their companies weren't paid. Times are hard for everyone, but it does not put you all in a good light colluding how to avoid paying a rightful bill.

The problem is not that they wish to ale a charge but the size of the charge they want to make, the sums they ask for amount to extortion, if the sums were in line with other parking charges they would be acceptable and be paid.

For a licence dated 1997 or later you must add together the plated max weight of the caravan and trailer, if the total is 3500 or less you can tow it. You may even tow a caravan with a MAM greater than the cars unladen mass the restriction was removed in 2013

But with respect, the post doesn't mention the amount or that it is excessive, just asking if they should pay or appeal. My point is that the invoice is valid so why lie to avoid paying?
I'll have a look at their charges but I guess they would be in-line with an overnight charge which is paid by all the commercial users?
The alternative would be to use a site for overnight, lots of people do this at the Dover CC site, I paid £28 to stay 1 night, arrived 11pm and left 5am. The site is set up for that

Nobody is suggesting they lie, the letter is addressed to the keeper who can legitimately reply tht they were not the driver, the whole thing is typical of rip off Britain at its worst, place a small notice in a place she it is not seen and then send off extortionate demands if it is not seen.
Like you if I stop en route I find a site, but many do not wish to, they just want a short break. However, I would not pay £28 for a night anywhere that to me is approaching extortion and I am an enthusiastic CC member, there are lots of small sites where a one night stay is a lot less than that.

Just found this which gives some good information.

The bit at the bottom is especially relvant it gives the email addresses to apeal to for the relevant service operator.

It appears that there is a legal requirement to provide 2 hours free but all services charge (typically £10) to stay longer up to 24hrs. The charges apply in all services and can be paid by phone or on site.All numberplates are recorded by an automated system. I believe it's £50 if the user leaves without paying that day but pays on receipt of the notice. If the notice isn't paid a £40 carge is added. Then an addition £120.
There are also several other posts about avoiding penalteis from this company but most concern incorrect charges or double charges.
Some fight it, sometimes the company give up, you roll the dice and I guess treat others as you would wish to be treated. Your call.

The OP had the opportunity to pay the parking charge on arrival. Frankly I don't believe any one who claims the thought they could stay in the service s overnight for free. As for it being too dark to see the signs, total nonsense. Motorway services are very well lit and the parking signs are also displayed in the entrances. As far as I am concerened the OP simply wanted a free overnight stop and got caught bang to rights.

I would agree that it should be common knowledge that there is no free overnight parking at motorway services & that signs stating all parking over 2hrs is chargeable are clear enough, the signs are even in the toilets. £20 is the normal overnight charge for caravans which is considerably more than many campsites charge & I would agree that is ripoff Britain at its best as foreign motorway services do not charge.

£5 would be a more realistic charge although I fail to see why their should be any charge at all. If anybody is tired on the motorway they should be able to stop & have as much rest as they require, it is a safety issue.

It was somewhat naive of the op to believe parking for that length of time would be free & that the car park company would have any interest in an 'appeal' on the grounds he stated.

However he is entitled to ask for other people's experiences & fact is that these charges are not legally enforceable except by civil action which is rarely pursued. Worth pointing out they can legally wheelclamp non payers tho. I have seen this done to foreign trucks at both Thurrock & Maidstone services.

Still doesnt change the fact the invoices and threats are totally out of order.

Its been done to death even watchdog had a piece on it. The one company claimed their invoices did not look like genuine council tickets. Shown on TV to be almost identical.

Then they said the council probably copied their tickets.

The way they do business has brought this about.

Charged £80+ or clamped and charged £300 to release your car because the ticket turned over when you shut the door.

No loss then no fee should be payable.

4 hours for a toilet stop, Beats my record :)

The latest legislation which has received royal assent refers to clamping.

subsection (1). A driver of a vehicle, by parking in a commercially run car park, may

have impliedly accepted the landowner’s offer to park (or that of the parking company

acting as the landowner’s agent). He or she may also, depending on what is advertised

at the car park, have impliedly agreed to comply with the terms and conditions

advertised, including the parking charges and the associated enforcement mechanism

for those charges. However, by virtue of this subsection, the operation of the law of

contract as it applies to commercially run private car parks does not confer lawful

authority on the landowner or operator of a car park to clamp or tow away a vehicle

parked there.

I think it's high time the Motorway (and other highway) services were obliged to provide a longer free period. Say up to 4 hours instead of the 2 hours that they currently allow.

2 hours just simply isn't long enough to get enough shut eye, use the loos etc and have something to eat. Frankly, most caravan parking areas at services are a blooming 20 minute hike from the loos and things to start with.

It's a safety thing - if the driver is tired they need a decent rest.

Overnighters are a different matter (how anyone could compare the 3.5 hours mentioned in the original post to an overnight stay beats me) If they set the charge at a more reasonable £10 then I expect most people would take the option of paying rather than driving on to the next one for another 2 hours worth and so on cat napping down (or up) the country.
