As far as the law is concerned it is the drivers responsibility to ensure he/she is not towing overweight. In reality there is some discretion used by dvsa officers, iirc 5%?....
I have a weighbridge so none of my trailers, vans or my caravan leave overloaded; I appreciate many are not so fortunate.
