Hello all,

Iam in need of your thoughts on a little problem I am having with a certain campsite that for now will remain nameless.  I booked a week camping with a large tent and EHU in the torbay area for just shy of £200.  Upon arrival to the site we were relocated because of the condition of the original pitch by the site manager, we then asked to be moved again as this pitch was too small for our large tent as we had notified on the phone with the measurements I provided.  The third pitch was very waterlogged and after walking round the site we found the lower pitches flooded.  When it stopped raining we pitched the tent and as we walked around the ground was so saturated it acted like a sponge, were we walked the pressure of our feet made the water rise out of the ground! during the night the tent pegs 'slid' sideways making the tent collapse and in the morning we found the whole grassed area had water standing just below the grass level evectively flooded.  We decided that we could not stay in these conditions and went to speak to the site manager who informed us we had to see the site manager of the site next door as they had just been bought out. he refused to re site us saying the site was adequate and would not give us a refund due to bad weather!

My argument is that it was extreme weather and we should have been notified that the site was a swamp before we arrived.  The site that we went to in the same area was wet and muddy and I did not have a problem with the rain I did not want to camp in a swamp!

Am I being unreasonable demanding a refund for what we did not use as the campsite in question is certainly making me feel as though I am in the wrong!

I think - but could be totally wrong! - that there is a difference between a camping holiday being spoilt by bad weather and being spoilt by unuseable pitches. I think you might have a stronger arguement for a refund on the basis of the site being unable to provide you with a serviceable pitch (which they have effectively contracted to do) than with the weather being extremely poor (which would be beyond their control).  MT

My first post here so Hello everyone.

I agree with Merry in that you have contracted with the campsite for them to provide you with a suitable pitch to erect your tent on. It is the same as buying a television that can only show pictures without the sound, under the sale of goods act it is not fit for purpose and so you are entitled to a refund. If the pitch is suitable and the weather is bad then you would not be entitled to a refund but from what you say that is not the case.

Also the fact that the site had been bought out has no bearing on your argument as under law the new owner takes on the responsibilities and contracts of the outgoing owner.

Responsible site owners should take account of the situation. The site we have just returned from was not taking the balance due on the holiday from people as they arrived (only a £30 deposit payable in advance) due to the state of the weather in case they did not stay, as many did not. We have also had a refund for bad weather in the past due to leaving early from them.

Good luck and make sure that you persue your refund.

Nice to hear that it is not just me and thanks for the advise.  I have been pushing the argument about the state of the pitch but the manager keeps swinging it round to bad weather.  I'm drafting a letter to the head office between typing this.  I have written my review for the site aswell Byslades in Paington.  there are so many other things wrong with the site aswell but the state of the field has been THE problem for us.
