Hi everyone, this is my first post on Uk campsite,

We purchased a Montana 6 tent end of June last year from Casey's Camping in Ilkley, and have had 4 great holidays in it with no problems last year.  It stood up to gale force winds in North Wales, and subsequent downpours without a problem.  however have just got back this weekend from 11 nights in Devon, had a little bit of rain and some moderate winds, (nothing as severe as it's stood up to before) got to the campsite on the thursday the 7th, come friday afternoon I noticed a 4-5 inch tear in the right window (as you stand in front of the tent).  The tear is along the stitching and runs parallel with the black triangle of fabric for the guyline.  Both of these window guylines were in use, neither was over taught and the winds were certainly less than the tent has stood up to before.  I have spoken to the guy at Casey's who said bring in the tent and he would look at it and "sort it out".  However I am just a little concerned, that they may try and repair the plastic window, and will this work ?

With the tent being less than a year old from date of purchase, would we be entitled to a replacement ?  We do really love this tent and have looked after her.  Tent is just drying out at the moment defore we take it back to Casey's.  Does anyone know how we could contact Outwell?

It does sound like normal wear and tear, even if the guys weren't over tightened just one big gust in the middle of the night could have developed the tear. Sounds like you are having great times in your tent, but with great times and lots of them comes, lots of wear and tear to a tent. Our new sunvalley 6 has only been camped in for 9 nights so far and we have ripped along the seam of the inner pod where it joins a roof toggle (i sewed it up on the spot), punctured a hole in the SIG (i duct taped it up on the spot), and I also wore out a hole in the undeside of my carpet (duct taped there and then on the spot). I suspect Casey's will be able to fix it and it won't affect the performance of the tent. I see all of my rips, tears and repairs as a badge of honour for my tents. A tent that is in pristine condition is a tent that is never camped in and enjoyed. I am certain that a peice of clear tenacious tape will hardly be noticable on the window tear, will work fine and will be a pleasant reminder of your happy holidays under canvas.

Well it's hard to judge whether this could be regarded as reaosnable wear and tear without actually seeing the tent in the flesh. But I tens to think though that I'd not consider the window tearing in that manner after this amount of use really fair wear and tear.

As to the point about replacement, no under the sale of goods legislation you have no automatic right of replacement at this stage, given the length of time and the amount of use. Assuming the retailer accepts that this isn't fair wear and tear, the the retailer can offer a repair. This should repair the goods to a satisfactory condition, should be completed ina reasonable time and should not inconvienece you too much.

If it does not then you are entitled to compensation, such as a sum of money, or loan of tent for a trip etc.

If a satisfactory repair cannot be made then you are entitled to ask for a replacement or a refund. However, the retailer can make a reduction from the price you paid for the use that you ahve had from the item
In the context of the tent window that would mean IMO, replacement material, properly sewn into place, seam sealed if appropriate etc.
