I bought a Carolina 3 on 20th June and only got the opportunity to do a check on it yesterday

The only fault is one of the plastic "cups" that holds the fibreglass poles is broken (split right down the shaft)

The dealer I got the tent from breezily said "we don't carry spares for metal poles" and repeated this even when I pointed out it wasn't the actual metal pole that was the issue

I am going to go back to speak to the manager when he's on shift but if they don't / won't help, am I within my rights to ask for a replacement pole from another tent in stock and then they can send the other tent with damaged bit back to Outwell, or whatever they do with them?

IF YOU WANT TO GET A FAULTY ITEM REPLACED OR REPAIRED

You have the right to get a faulty item replaced or repaired, if you're happy with this (or if it's too late to reject it). You can ask the retailer to do either, but they can normally choose to do whatever would be cheapest.

Under the Sale of Goods Act, the retailer must either repair or replace the goods 'within a reasonable time but without causing significant inconvenience'. If the seller doesn't do this, you are entitled to claim either:

    * reduction on the purchase price, or
    * your money back, minus an amount for the usage you've had of the goods (called 'recision').

If the retailer refuses to repair the goods, you may have the right to arrange for someone else to repair it, and then claim compensation from the retailer for the cost of doing this.

You have six years to make a claim for faulty goods in England, Wales and Northern Ireland; in Scotland you have five years.

I'd be asking for a whole new tent - especially since you haven't even used it.

If you get further hassle just mention that you will be in touch with your local Trading Standards Office. These magic words can work wonders.

I would firstly ( and nicely) aproach the on duty manager, and work your way up to the top if this doesnt work then sale of goods act needs to be inplied

Merlin is correct, the term you should use is 'fit for purpose'. As the tent was'nt supplied to you in a condition in which you could use it for its intended purpose, this is against consumer law. You are entitled to a refund or replacement.

I've just had my first week in a new Carolina 3 and I am very concerned about it.  The velcro which fastens the doors has the 'prickly' bit of the velcro on the outside so it catches on the mesh doors.  Already it has clicked the mesh quite badly and I suspect it won't be too long before it tears open.  I'm going to try to find out whether this is a design fault or a manufacturing fault i.e. the bits have been sewn the wrong way round.  How is it on your Carolina Cinderbecca?
