Hi All

Many thanks to all of you who have been so kind and supportive. I really hope I am not boring you all with this!

I must admit I was getting myself into such a state as to how to handle this yesterday but in the end did try to telephone the seller. His wife advised that he was at work and took my number. However, I decided to send him this email btw I have kept all emails from him, just in case!:

"Thanks for your reply.
 
You may know by now that I tried to contact you and will hopefully chat tonight!
 
I'm really sorry to have to say this, but my 'contract' if you like, is with yourself and not your friend/business partner.
 
Really don't want to go down the route of reporting to Ebay & Paypal unless I really have to but the fact that it will cost me more than £30 to replace the pole bag and buy a groundsheet is not acceptable, especially as the original advert did specify the ground sheet.
 
Also, having to pay the postage to return the item is not acceptable either.
 
I am still hopeful we can mutually resolve this and just to assure you I am not looking for a full refund. Also, without wishing to sound rude, how can I be sure that I will get the refunds offered?
 
As for saying 'this model may be 8yrs old but the tent itself is brand new,never been used and would have cost four times as much as you paid when new model' is a bit of an irrelevant statement when this model can longer be found never mind purchased!
 
Ever hopeful that we can resolve this."
 
He then wrote back with this:
"can appreciate what your saying.Will have another go at him hopefully we will get it sorted"
 
To which I Replied:
"Many thanks, not looking for huge re-fund, something like £60 minimum should hopefully cover everything we need to get with a little gesture of good will for the inconvenience and problems we have been through with regards to the situation.
 
After all, he has not upheld the trade and description act.
 
As mentioned, am hopeful we can get this resolved, can you please advise as to how he will refund the money too and when to expect it?
 
Will you be calling later or emailing?"
 
Then he wrote this later in the evening:
"just been with him and i am going with him tmro to the warehouse to pick out a groundsheet and pole bag.Will email you when i've got them and an expected delivery day/time ect.I can assure you this has not happened before as i have a 100% feedback on the tents but like i said i didn't know this model was being sent to you and i have done all that is possible to resolve it.This is an isolated case and i hope its not repeated as its not worth the £20 i make from it"
 
To which I replied this morning:
"Does this mean that you are going to send a ground sheet, replacement pole bag and the £30 as originally gestured for sending the wrong item with only  1 bedroom?Obviously you will need to ensure that the ground sheet is the right size for the tent"
 
So, it would appear with the threat of ebay, paypal and the mention of the trading standards act may be getting us somewhere at last.
 
We have decided to keep the tent with all this in mind. If he does not fulfil his agreement to resolve the situation I will then go ahead and report him to Ebay, Paypayl etc.
 
What do you guys think????
 
Thanks once again for your time and patience... Love this site by the way, it's becomming addictive (reading others and joining in that is, not this situation!) and I've so much work to do....

Yes, this site is addictive. I onl yjoined recently, and am finding hard to tear myself away...there's housework, ironing, prep for camping on Fri...and STILL I type!!

My hubby says I need a life, and real friends not virtual ones!!

Nah, real friends are never always that honest and as much fun..

I only joined last week when trying to find info on the 'said tent'. Never knew forums existed for tent campers!

Gonna have to get some work done though or the boss will have my guts for garters!!!!

I still think you are being sold short on the fact it has the one bedroom not two as advertised.

whilst he is in retreat and trying to sort it press home the advantage

To be honest with you i think it all sounds to confusing the next thing that will probably happen is you will be sent a groundsheet which is to small or not get the £30, you only have 45 days from the day you paid through ebay otherwise after this time you are not covered & on ebay i think it is 90 days so remember this otherwose you well & truly could lose out!

To be honest i would be asking for a "full" refund & stating that because they have to advertised the same tent they have sent you it is there mistake & "they" will have to pay for the p&p for the item to be returned.

At the end of the day they have broken the rules & it is down to them to be sorting this mess out.

Once you have your full refund i would then go & buy exactly what you wanted in the first place off ebay from someone else.

personally I would open a dispute with him via ebay - http://pages.ebay.co.uk/help/tp/problems-dispute-resolution.html?fromFeature=My%20eBay

 By doing this it puts the ball in his court to deliver on his promises + all correspondance is logged & monitered by ebay, the dispute can be closed again when you achieve a settlement.

 It is a simple process to open a dispute & it generally has the desired effect especially if the seller has 100% positive feedback as he will be eager to retain his good reputation.

Sorry I Agree with Bryan_K. You should report him to Ebay its people like hime that get other people selling on ebay a bad reputation.

Sounds like you are being strung along, untill time has run out and you no longer have any redress through Ebay.

You have a genuine grievance that needs to be resolved.
