A few months ago we took our cubs to camp, it was a big event celebrating the 90th birthday of Cub scouts, there were 600 cubs and leaders there. 

While on the camp one of my young leaders had his brand new tent wrecked, the warden of the site fell onto it and smashed the poles, rendering it completely useless. I wouldn't mind if the bloke came back the next day to see if everything was ok, but he did not even bother.

Now am I right in thinking the site should have some sort of insurance to cover things like this? Should my young leader be able to claim compensation?

I hope this is the right place to post this!

Any responsible site would carry Public Liability Insurance to cover just such an event but it is not a legal requirement.

I think regardless of what insurance policies exist, the campsite should pay as it was one of their employees that broke it.  Just for the sake of public relations they should pay let alone the moral or legal reasons.

Are you not insured through scouting insurance  you should have when you take cubs away to camp. Your yearly census goes towards it. I would ring your scout HQ and ask they will know. or speak to your local comissioner.

i know in guiding you are insured I am sure that must cover damage to equipment  as well as yourselves.

I know this isn't really helpful but how long ago are you talking, will it make any difference to insurers that it was not recently and is only just being reported to them?

Usually the first port of call is your own insurance. I assume from what you have said that the incident was an accident. The warden might not think that it was his fault.

Hi folks, this happened in July, we have been trying to get it sorted out for ages, I have emailed various people and my Akela has said he will try to ask the DC about what's going on. I just would have thought the bloke that fell on the tent at 12.30am while walking his dog around the campsite would have come and sorted it out the next day wouldn't you. He said " I saw the tent outline then I turned around to look for my dog and then I fell into the tent". How many pints I wondered!!!

I think I will have to find out if our group have any insurance that will cover it. I feel so sorry for the young lad he was so chuffed with his brand new pop up tent!  He was only in it about 20 minutes and the guy fell on to it!

I think we will also try contacting the site again and see what they have to say.

i can't believe haw irrisposible the warden was. I would have offered to pay for the tent straight away. Have you actually tried to contact the warden directly, i always thought that people in scouting and guiding were an honest lot!

I would be tempted to ask the Management at youe Scouting Association to write to the site concerned, expressing their concern at a Warden falling around into tents etc. and enquiring about recompense on your behalf.
You have tried to deal with this, so its time to obtain help from higheer up the chain.

Did the Warden know whether a Scout was injured by his activities or not? Did he take reasonable steps to find out whether he had caused injury?

A Scout tent is not an easily concealed item, and the Warden could reasonably have expected a tent to be there, so the damage would have been caused by incompetence or negligence.

Finally, how much would the site lose if your booking was cancelled next year, as opposed to a new tent?

Was this a Scout site?

I would be worried about any warden getting that close to the kids tents at that time of the morning.

Ive had the scouts away many a time scout and comercial sites and never known a warden being out at that time.

He should definately pay              NAME AND SHAME

Never mind the tent, was the young lad hurt at all? It must have been a bit of a shock for him if the guy fell heavily enough to break the tent poles!

Was the incident noted in a report book? I should think that, so long as it was recorded, you will have some comeback for compensation. An apology would be nice too, I'm guessing?
