In May 2015 my dad had damp repairs carried out on his caravan.
Recent damp checks and reports by other repairers deem the repair to be unsuccessful and inadequate.
We have tried making phone calls, and sending letters since November but have had no response. We were given a 12 month warranty, so by ignoring our attempts at contact he is breach of the promise he made.
We sent a letter before action, and have received no reply.
He is also in breach of the Supply of Goods and Services Act 1982, arising from repair work completed without the necessary care and skill.
I would like help with the "particulars of claim" before commencing with small claims action.
Can anyone who has done a small claim before please advise if I post up what I have so for the particulars of claim.
I would advise to phone your county council (not the local council) and ask for the trading standards. That way you get the right information you need and they will take some details from you regarding the company in question to see if they are legal traders or not etc. and point you in the right direction.
Is he still in business repairing caravans? Even if an order is made against him to pay money you might be unlucky. You need to be prepared to take this all the way. You are going to have to pay for a detailed engineer's report & an expert witness to attend court. Then if he won't pay, you pay for a warrant of execution & so on.
Record of small claims court claimant recovering all monies owed is not very good & particularly so in case of rouge traders. Tools of his trade & business equipment cannot be seized & so on.
It's a minefield, how much money are we talking about here?
