Hi hope someone can answer this for me. Are poles covered under the guarentee on a new tent?

I bought a tent last September, and apart from putting it up in the garden to check everything was there, I have used it twice so far. One trip was over night the other for 2 nights. I now have two sections on one of the poles which have split length ways. On contacting the manufacturer I was told to speak to the shop I bought the tent from. This I did to be told the poles are not covered by the guarentee as they can easily break (wear and tear). The tent is less than a year old, surley this should come under the sale of goods act - as not fit for purpose, or is the chap in the shop correct?

Any advice would be gratefully received.

That is a tough one...

Poles can break during normal wear and tear... But it is proving how it broke that will be the problem. I would suggest you actually get back on to the manufacturer.

Some manufacturers cover poles and some don't, so a nice letter with a copy of the reciept may be the way to start. If you get no joy, then be harder.

Your contract was with the shop, not with the manufacturer.  Unless the tent was misused or subject to extreme weather conditions, under the Sale of Goods Act I would claim that it was not fit for the purpose.  The terms of the guarantee are irrelevant to the claim and are being used by the shop as an attempted get-out.

The tent was used for 1 night of fair weather camping. Then the problem was noticed when it was used for a further 2 nights camping while another exactly the same tent was used with no problems.

I hate complaining myself but they are really taking the p1ss Breeze. Bernie is absolutely correct - the pole is/was not fit for the purpose and is obviously faulty. I would speak to the shop again and if you get no joy then put it in writing quoting the SoG act with back up from consumer advice - they even do template letters.

Thanks guys, I will go back to the shop, felt I was getting the run around from him, it's just sometime you are not 100% sure where you stand. I have an independant witness (Oops) as to the conditions when being used, and as Oops says, exactly the same tent was used with no adverse effect.

Nice but firm I think!

Hi Breeze,

We brought a Khyam Ontario 8 last year and went away in June to Cornwall when the bad storms were happening.
Our tent poles also split down the length on all but one assembly.
Managed to get through holiday with gaffer tape but on returning contacted the shop where we brought the tent from (internet purchase) and we had these replaced free of charge.
Had to pay for postage to get them delivered to the shop but they then returned them.
I would recommend that you contact again and point out that our tent is not 1 year old and only been used a few times.
