We bought an Outwell Hartford L in the end of season sales last October but were unable to pitch it right away as we were getting married a week later. After the dust settled (so to speak) it was then winter and the tent got stowed away in the loft, completely unopened.

We had planned to go away over the spring but that trip fell through and so it was only last week that we got it out of the roofspace to test it before our main trip to Cornwall. To our horror we realised there were no poles.

Blacks have been very helpful. They have told me they have gotten in touch with Outwell a number of times but no-one has returned their calls. Blacks informed me they cannot give us a full refund (fair enough as it was bought some time ago) but were willing to give me a giftcard-refund for the value of what we paid. This is generous but the only problem is that we only paid £200 for what is a £400 tent. If we take the gift card at best all we can buy is a £200 tent.

We were able to produce the receipt and show them a tent that has never been used and still has the sale labels on it...that is not in question. We thanked Blacks for their kind offer but asked that they continue to chase Outwell for the missing poles...is this the right course of action or should we accept their offer of the giftcard-refund. Or do we need to step up the pressure and go down the 'fitness of purpose' and 'this has nearly ruined our holiday' route, stamp up and down a lot and make a lot of noise?

Worth bearing in mind that we are now in Cornwall in a cheap Argos tent which, to be honest, is absolutely grand but not, I imagine, in the same league as the Outwell. We do have another trip planned for the end of summer when we will be touring Ireland for a week before a wedding, so I imagine the Outwell would be a handy tent to have.

That a terrible thing to happen. I would ask citizen advice their views on this, but due to the time factor it may be £200 is better than nothing its a real shame you didnt check it soon after purchase.

I'd be on the phone to Outwell myself and cause an almighty fuss about them not replying to Blacks.

Worse case scenario you buy a set of poles. They wont cost £200. So that's a better option than taking a credit note

Phone them you've nothing to lose.

Thanks for that arsenaldes. I had no idea that Outwell were on Facebook. I have now gotten myself on to their page and it makes for interesting reading!

I have been on to the citizens advice bureau website and it is quite clear..the fault lies with Blacks unfortunately, as they are the trader that sold me the tent. It is also clear from the website that the tent has been sold and is not fit for purpose so a number of options exist, ranging from repairing/replacing, to a credit note, to a full refund. It has been a little more than a week since I first got in touch with Blacks so I reckon I'll give it a day yet then phone Blacks again then I'll take rallye's line and raise merry hell with Outwell about not getting back to Blacks sooner - that's a nice approach to take as otherwise they are likely to swat me away and for me off onto Blacks - thanks rallye!...I can't wait to post something on that sacharine-flavoured Outwell page!!

The refund part is a tricky one as more than 6 months have passed and you did not notify Blacks sooner

"Getting a full refund

If things go wrong with goods you have bought, you have the right to return them and get all your money back (a full refund). However, this right only lasts for a very short time after you buy the goods. You are allowed a short time to examine the goods and try them out, but you must tell the trader about the fault as soon as you discover it. It will be up to you to prove that there is something wrong with the goods if the trader doesn't accept this.

You will not be able to get a full refund if you have:

    continued to use the goods after you realized something was wrong
    tried to repair the goods in any way
    kept the goods for too long without telling the trader there is something wrong with them, or noticing the fault.

If you aren't entitled to a full refund for one of these reasons, you may be entitled to get some of your money back, or to a repair or replacement instead – see below.

If you think you are entitled to a full refund but the trader offers you one of these alternatives instead, you may want to think about accepting it, but you don't have to. To find out what you can do if a trader refuses to offer you what you're entitled to, see under heading"



So they are offering a refund, maybe you can argue for the cash (or refund to debit/credit card etc) rather than gift card, but as they no longer stock this, if they cannot get hold of replacment poles for you, you may have to take the refund on what you paid in one form or another, though cost of a new set of poles may well be a lot less than adding the extra to your £200 to get what you wanted.

Its a pain because you thought you had a bargain, but do not have, You may have found in November if you had checked it then that they could only offer you your money back, and back to square one.

Stick with trying to get Blacks to keep trying in getting hold of Outwell, but if they can't eventually they will just be offering you your money back. Try not to annoy the staff into just wanting to give you your money back and be done with this, so that they keep trying. In the end you may have to make the choice of getting hold of a poleset yourself or accepting a refund and choosing something else. Once you accept a refund thats it, its final.

Do some research on how much a poleset will cost if you can source it from somewhere. If Blacks are really getting nowhere with getting the poles from Outwell, then maybe discuss with as senior member of staff you can get to talk to to see if you keep the tent and source some poles yourself, whether they can sort you a gift card as rsome form of recompense for the inconvinience and extra expense you wil have.

It's not a good situation but due to the time involved whatever you get you are doing well. You need to inform the retailer within a reasonable time of any faults or missing parts. You have very little legal standing.
Saying all that a good retailer will do all they can to help. I would give blacks a little time, all I can say about Outwell is they always get back to me as a retailer very quickly, normally the same day or within 48 hours at worst. It's situations like this that we learn from in life.

Without wishing to rock the boat or cast any doubt on your situation Greengael (after all mistakes happen), you may meet some resistance from Blacks due to the time involved.

Outwell's quality control is generally very good and they actually weigh every tent as it passes through their warehouse to the nearest gram on digital scales (a bit like banks weigh money) - this ensures that even something as small as a missing peg gets flagged and rectified before the tents come out to retailers.

Having said that, mistakes can happen but given the Hartford would have been noticebly light on dispatch/shop handover and also given this weighing process you may find some sceptisism from Blacks staff.

Regardless of the truth of the matter - and I see no reason for your story to be anything other than genuine - it's one thing calling up straight away and saying "I've got no poles" and quite another to say the same thing months later.

Sorry to put in a downer but just thought you might like to know what they're thinking

I think what I might be inclined to do is contact another branch of Blacks ask them if they can order you a set of poles and the cost if they can accept the credit note and order the poles

Thank you all for the advice. It is so interesting to see so many different perspectives especially from the retailers..it is good to have insight as to how the 'other side' see things.

There has been a little movement now, saying all that. I spoke to Blacks today and Outwell have finally gotten back to them (after a week and a half, I'll add). Blacks have asked me for the upc barcode number so they can be absolutely sure of the year and that the poles they get will fit my tent. Hopefully this means that it will not take long to get this resolved now.

I would like to point out that Blacks have been great through all this..a real class act: they were initially very happy to give me the refund with few questions asked and have been great chasing Outwell, and now it seems Outwell are going to show that they are good eggs too - and thankfully all without me having to jump up and down! I can understand if there is some kind of charge for all this and indeed I was willing to buy my own set if needed-be:- talking this through on the forum and reading Gary Cross and Campingworld's comments as well as arsenaldes and loftus' thoughts really helped set things in perspective.

Again, thank you all so much for the help and advice..it goes to show what a great facility this site and the forum is.
