Hi, could anyone please advise me, we sold our static caravan through our holiday home site and we was quite aware and accepting that we would have to pay for they're commission and vat charges but my worry is that the site told us that we would get our money for the sale of the caravan within 2 weeks, it's been nearly 3 weeks with no cheque and the buyers have been allowed to move in over 10 days ago. How can this be right and am I still the owner as we haven't been paid. Thankyou any advice would be welcome

personally i wouldnt have handed over the keys until payment had been made, to stop the situation occuring as you have just found yourself in now. have you made contact with the holiday company and asked why? if they have given some excuse and still nothing happening then i suggest you seek proper legal advice and get a letter sent to them asap

forget that its a caravan and treat it like any other item that you havent been paid for, take immediate legal advice and follow that advice


id be tempted to turn up and gain entry into the van if you can (not by force obviously) and refuse to leave until you received your money, until asked to leave by a police officer of course, after showing them the evidence of theft by either the current 'occupier' or fraud by the site!

I would have thought that you are still the legal owner until the payment has been received. It's no different to buying a caravan, motorhome, boat or car on finance, it doesn't legally belong to you until the final payment has been made in which the finance company sends out confirmation to you. It's no different with a static caravan either and because payment has not been received I would consider that you have a very strong case against the third party involved. However, you need to seek legal advice immediately to find how you stand.

what does your bill of sale say?
For example, when you buy large item goods on credit, the paperwork states that title (of ownership) does not transfer until full payment has been made.
Your paperwork should clearly state how and when ownership transfers, who ownership transfers to, how and when payment will be made, and who will pay you - the park as the new owner? the people who have moved in as the new owners? or the park as agents for the buyer?.
I hope that you did get paperwork for the sale - but if you did not, then the park has no evidence that they own it, and no evidence that they can resell it.
As already said, a static caravan is simply a large item, and treated in exactly the same way as a TV, car, fridge, etc.
Your local Trading Standards should be able to help, or you may have a legal advice help line (or even legal assistance) with your home insurance.
Bur before going down all this route - have you asked the park where your money is?

The insurance company that insured the static should provide legal advice. You have a contract with the site and they are currently in breach of contract by not paying you. I expect it’s just “creative accounting” - cheque run is at the end of the month or some other valid reason.
But first thing needed is a phone call to the site. Talk to the appropriate person. Record it on your mobile, just in case & also tell them that you are recording it.
Odd to get a cheque too - bank transfer is quicker & doesn’t get lost in the post.

If you approached the people currently living in it and told them that you were still the legal owner and giving them 24 hours to vacate, they will soon get onto the site owner and put pressure on the park to resolve the issue.
