I have recently bought a static caravan, 24 days ago. Do I have any rights to cancel and get my money back.
The site that I have brought the caravan on is not nice at all. Very rowdy.
Can I get my money back?
I think you will need a very good lawyer as CRA 2015 may not apply to a residential unit? Suggest you contact Which Legal Services as soon as possible and definitely within 30 days of purchase just in case CRA 2015 does apply.
I agree with Iank01 on this one, you will need a very good lawyer. You have bought a static caravan, and that doesn't include the site, which you rent. I think you would have to prove that there was a major fault with the actual caravan to get your money back. I doubt whether anything about the site would come into it. I wish you luck and hope you do reach a satisfactory outcome.
whether holiday or residential, a static caravan is, in law, a chattel - same as a car or TV or saucepan.
So the consumer act applies, but as others say, you need legal advice as the right to simply change your mind depends how you purchased it - whether you saw the item before purchase or not.
Colin21 has made a very strong point about the pitch - the purchase is two parts, which is the chattel (the static) and the contract to use the land (the pitch).
IF you purchased before you saw the pitch and IF you were mislead about the park in general, you will have a better case.
Sounds like: I bought a new house but I don’t like my noisy neighbours. There’s nothing wrong with the static, it’s the pitch you dislike - maybe you would be able to move to a different pitch (at a cost, probably). But I know nothing of the details of owning a static, so that might not be possible.
Meanwhile, as others have said, read the contract very carefully & then get legal advice quickly.
It's more than the pitch, it appears to be the whole site.
Possibly not enough research done on it.
------------- XVI yes?
As well is two words!
How does a sage know everything about everything? or does he? or does he just think he does?
Remember, if you buy something you bought it, not brought it.
