Just a thought for discussion.   Had to attend a training course in my new job recently which had an item on Equality and Diversity (yawn, etc!).  Anyway, new age discrimination laws were discussed relating to the Equality Act (of 2010 I think).  An example was brought up as to whether adults only holidays, in particular adults only campsites, were in fact discriminatory.  The guy giving the lecture suggested that until there was a test case, there was no way of giving a definite answer however in principle he was of the opinion that adults only sites are clearly breaking the law, unless they offer licensed facilities or over-18s entertainment. Apparently the same goes for sites that refuse same sex groups, or holidays over or under a certain age group.  A site we have visited in the past with our kids is now adults only which is a great shame but I understand perfectly why people would prefer them (I certainly would have before the kids came along).  Any thoughts or legal opinions out there?

Can you discriminate against a child because of age? There are many circumstances where it would be wrong to allow a child to attend, film classifcation would be an example. I thought age discrimination was where your treated two people differently. I doubt that applies to children. Perhaps Phil can help us here. Here is a stupid example, would I as 66 year old be allowed to enroll at the local play school?

The lecturer told us (rightly or wrongly) that age discrimination applies from age one upwards, and he thought in particular that a site which catered for families previously then changed to adults only would be 'on very thin ice' (his words).  Obviously there are extreme examples as you suggest! Apparently 18-30 and over 55 holiday companies are looking into changing their wording, ie 'more suitable for ..'  Like to hear a proper legal response.

Yes, that's a good point, evenstephen.  I will admit we take advantage of that too.  Discounts for older, and probably younger, age groups apply throughout life don't they? ie, insurance, cinema/theatre tickets etc.

Equality and diversity , it sounds like job straight from the EU , a gang of parasites who don't actually produce any thing , and are just looking for ways to justify there title , local councils are full of them , and we the taxpayer are paying for it , next we will be saying children should be allowed to drink in the pub , mustn't discriminate against the smoking bring that down to 8 , what about allowing kids to drive a car , should all houses be the same so the poor wont feel left out , all these none jobs or Quango's have all come about from the EU , so where do we draw the line with discrimination , only today I read that prisoners didn't like there dinner so the warders had to go out and buy them a meal from a take away , your lecturer is just trying to justify his wages ,

Calm down Joecroft2 - Have you not heard of Emmeline Pankhurst? Nothing to do with the EU. You'd be better off not reading the Daily Mail.

Exceptions

Under the Equality Act 2010 there are some general exceptions which permit discrimination in the provision of services, the exercise of public functions or the activities of associations which the Act otherwise prohibits. These exceptions now apply to age.

In addition, alongside the new age discrimination ban, there are now some new exceptions which relate specifically to age: These exceptions allow:

-The use of age in financial services including insurance;
-so called ‘beneficial concessions’ in services, for example, cheap hair cuts for pensioners, cut price or free travel related to age
-age-linked holidays, for example, Saga; Club18-30
-services restricted by age under other legislation, such as purchase of products such as alcohol and cigarettes
-use of age criteria in immigration control
-residential mobile homes – minimum age limits for sites
-sports – to allow fair competition, for example under 21’s football will still be lawful
-For clubs and associations, there is also an exception which allows them to offer age-based concessions such as reduced membership fees for particular age groups.

It’s important to note that there still is no protection from age discrimination with respect to premises. This is because it is government policy to allow landlords to continue to be able to target accommodation at particular age groups.
