Sadly we live in a Litigation at the drop of a hat society, now days.
A case of what can I screw out of some else, for monetary gain.
Which is why there are so many Personal Injury Claims companies around now days. Some of whom will make a claim on behalf of their client, on the slim chance, the person they are claiming against, will not fight the claim. And settle out of court, because they know full well, if the person fights, and it goes to court, they are on a looser, with a big bill. Which is why so many claims made by these companies, get dropped without result. But not before the person they targeted, is out of pocket, and has had months of worry and stress.
In the case of a child getting hurt, these Claims companies, will go after the Camp Site Owner, as being the easiest target.
A friend, involved in another hobby, had a PIC Claim Company, try and get him to settle a PIC by their client, who had tripped whilst out in the woods, and broken his ankle. They submitted dual claims against my friend and the Landowner, luckily enough, my Friend, had a Barrister on his side. On a Pro Bono basis, the PIC Company eventually dropped the claim, despite multiple requests to go to court to resolve the claim. It was dropped, because they were well aware they would loose in court. Now imagine the Bill, if my friend had to employ a Lawyer.
Now take a case of a parent of a child on a camp site, whose child is injured, using what is not a suitable piece of equipment in a public area (just like Skate Boards/Roller Boots and Heelies) and decides to submit a claim against the Camp Site owner, for allowing their little darling to use the equipment, in such a inappropriate location. The Insurance Company might just settle to make the claim go away, or might fight it. But either way the Sites Liability Insurance goes up, so who absorbs that increase? The Camp Site Owner, or those staying on the Site, by a increase in pitch fees, not the Little Darlings Parents, who will most probably never return to the Site
