I have recently bought a 80w folding solar panel from a friend. he bought on the 11th of june last year. I tried it last week and it didn't work. I spoke to the people he bought it from and they said that it couldn't be repaired under warranty and I would have to pay any charges. I have the original receipt for it. am I covered for the repairs under the original warranty.

Forget the warranty, under the Sale of Goods Act it should be expected to last more than a year otherwise it is not fit for the purpose.  Ask for a refund or replacement.

Do the company know that?

I think is all academic who bought it from who really - as long as you have the original sales receipt and it is less that 12 months old, it should be repaired or replaced under warranty!

Get your friend to deal with it as the contract is with him/her. A lot depends on how long it would reasonably be expected to last before going wrong rather than the length of the warranty. We had an 18 month old washing machine replaced when the warranty was only for 12 month. The sale of goods act is an extremely powerful weapon which extends far beyond a normal warranty period

i am going to add to this, as you have had the item for over 6 months, you [the consumer] will need to prove that the item was defective at the point of purchase to the retailer, you have up to 6 years [5 in scotland] to make a claim

however as stated above it is still down to show the life expectancy of the item.

The fact is the OP has no contract with the shop. Yes as they bought it from a friend the friend can talk to the shop but as it was purchased some time ago so it is up to the shop to decide if they will repair,replace or refund but again the contract is with the friend.
I'm not saying this is how I would deal with this but these are the facts.

it seems you are right gary. I spoke to the shop yesterday and they said as the panel has been sold on the warranty was with the previous owner and not with me. so it looks like I will have to pay myself. I hope there isn't much wrong with it as the previous owner only used it once before he sold his caravan, hoping its a fuse. david
