they cannot charge vat on a second hand van

i have reported it to ebay so listing will be removed

huh? how do you figure that? If it a company asset of a VAT registered company then they have to add VAT to the final figure - they are also being up-front in stating this.

I used to work for an Outdoor Pursuits company and we used to sell off the vans that we used as offices / accomodation at the end of a couple of seasons - some were good and some were dog rough!

I now work in construction and there is less and less of a tendency for companies to buy vans to accomodate workers as the legal site responsibilities for welfare provisions now make this prohibitive. We have just undertaken a big contract in Scotland and looked into this - the costs were less than B&B accomodation but the main contractor had banned caravans on site.

As for the condition of this one - would people honestly bid on a van without going to see it first??

the vat was paid on the van when it was new

and if vat was chargable why is it dealers dont charge

vat on the second hand vans they sell.

i am pretty certain it like the car trade they cannot put vat on a used car.

commercial vehicles ie vans lorries etc are vat chargable as

the company that bought them new claimed the vat back on them

and vat has to be paid on them when they are sold.

you dont see caravan dealers pricing at plus vat

so im pretty certain they cant charge vat on the vans they are selling

i may be wrong but i dont think so.

vat rules are odd to say the least.

what is the problem , they are not hiding anything ,work out what you can afford with 17.5% added and that is the final price , all this reporting to ebay is silly if you do not know your facts , if you do not like it dont bid , it is  as simple as that

Someone just bought our van off ebay without viewing and we had 5 other offers too - again no-one came to see it! - personally I would never buy a van without viewing.

If the company bought the van for buisness use ie accomodation on site for their employees-they will have claimed the vat back when they bought it so they have to charge vat when they sell it.-I guess the occupants would have been smokin, drinking & frying breakfast in it while tramping in & out with muddy boots.

If this seller is VAT registered and bought the van as a business asset, then he will have claimed the VAT back as part of his normal business. When he then comes to sell it VAT is due on the residule value.

When a caravan dealer buys your caravan, VAT has already been paid. However any profit he makes from the sale of the van attracts fresh VAT and he allows for this as part of his 'mark up'

if you dont report the scammers to ebay

it will never be able to get its house in order and more people

will get ripped off.

this seller if he is right will be asked to show that he is vat registered

and that vat is payable on this van and then allowed to carry on selling

his van, so in my eyes i think that by reporting it to ebay

and you do buy it and vat should not have been charged

it stopped you or someone else from being ripped off

and the more the scammers are reported the more chance

that ebay looks at them properly and puts a stop to it all.

I agree - report the scammers to ebay but his guy is doing nothing to scam anybody

he clearly states that the van has been used as a business asset so the VAT position is pretty much cut and dry

he clearly states that the van will be subject to 17.5% VAT upon completion of the auction

If there were any issue with the sellers VAT status (the ad gives absolutely no reason to think so), it would be an issue for HM Customs & Excise not ebay.

I agree that there are certain aspects of ebay that need sorting but this is not one of them. If ebay are to sort things out they could do so easier if they didnt have to waste time on misguided complaints like this.

Mind you, if we let this one slip through we will be back to the old scenario of allowing people to sell Aqua-Rolls without handles again!!

I thought this ad read perfectly okay to be honest.  He stated his position, the useage the van had had and their status as a business and the VAT addition.  I think Ebay has far more problems to deal with such as the buy it now massively under priced vans which don't exist!

My business bought our caravan and claimed the VAT back (its used for temporary accomodation very occasionally), when it is sold VAT will be charged and repaid to Customs and excise, the buyer will get  VAT invoice with my VAT registration on it.

That how it works and thats how it must be done, I cannot sell it without adding VAT.

Its basically a C.O.D. It would be different if you had to pay the whole amount up front through PayPal and then find out it was a scam. Seems a bit elaborat for just to make £250.00
