Sorry just seen that your van is an Avondale, do you mean the dealer has folded or do you mean given that Avondale have ceased trading?

Hi sorry should have given a bit more detail,

It is an Avondale caravan which has gone in to admistration, and the dealership where i brought the caravan from has now ceased trading.

There is a a problem above the front window, water is some how getting in and running down the seal flooding that and running back in to the van.

I placed a towel under the window went back 3 hrs later and was able to quater fill a washing up bowl by wringing the towel out.

Not really sure how to stop it or where to turn now, Im new to all this im a 27 year old girl with no father to turn to for help.

Ok Lakisha here's my suggestion.  I don't think you have any recourse to anybody because both the dealer and the manufacturer have gone tbh.  May I suggest you post separately on here asking for Wizard and the gang who have done repairs.  They may be able to give you advice to at least stop it, whilst you seek a quote from a caravan repair place or tackle it yourself if you can!  A full sized cover would of course be an excellent solution whilst you ponder your options, not cheap at £200 plus but what price to stop the damp?

Google specialized covers for instance, we have one of theirs and it is great quality.

Hi Lakisha

Our brand new Avondale did exactly the same thing a couple of weeks ago.  At the time we were able to get the dealer to have a look at it (it is on a seasonal site).  All he did was put silicon right along the top of the window - you will be able to see exactly where the silicon is from the manufacturer.  Straightaway we tested it and it has not leaked and we have had some very heavy rain.

I would suggest doing it yourself - just follow where the original silicon is and anywhere else you think it should go.

I contacted East riding trading standards on Friday and got this reply.

 

Dear Mr Taylor

Thank you for your message of 4 October, regarding your caravan warranty.

I understand that you purchased your caravan from Frysport Ltd at Hutton Cranswick.  If this is the case your legal rights under the Sale of Goods Act 1979 (amended) would be against Frysport Ltd, should your caravan prove to be defective or misdescribed.

New items are often supplied with warranties from the manufacturer.  These are in addition to a consumer's right to claim against the retailer regarding faulty or misdescribed goods, under the above law.  It appears that the manufacturer of your caravan has gone into administration which may prevent you from claiming from them in respect of the warranty, if it is no longer valid.  However it does not prevent  a claim being made against the retailer under the above law.

Frysport Ltd is offering to sell you a warranty in place of the manufacturers warranty.  If your manufacturers warranty is no longer valid it is for you to decide if you wish to accept this offer, decide against purchasing a warranty altogether or shop around for an alternative warranty.  

The practitioner dealing with the administration of Avondale Coachcraft Ltd is Price Waterhouse, Coopers LLP, Benson House, 33 Wellington Street, Leeds, LS1 4JP.  Enquiries should be marked for the attention of Nick Talbot, who can be contacted by telephone on 0113 289 4048.  I would advise you to contact Mr Talbot to check if the warranty is still valid before making a decision on what steps you may wish to take.

Does this mean then that, as our caravan is only 6 months old, and say we have a leak in the next few months, Frys would have to honour the repair?

So does this mean that if the dealer offers the buyer the chance to purchase a warranty, then his responsibility is now null and void?

I would have thought that T/S could have been a little more clear as to the course of action you could take in the event of a claim.

The Avondale warranty just might have been covered by an insurance policy.
Manufacturers have to carry Product and Public Liability insurance by law. The problem is that this insurance may not automatically cover insolvency. Therefore the policy may just have died with the company.

Its not 100% clear to me either so I sent another e mail asking for clarity on this. Trading standards then sent me a document on the sale of goods act 1979 which is a fairly easy to read document but covers everything. As far as I can tell if you bought your caravan and it has gone wrong in the first 6 months then you can claim on this act and it would be the dealers responsibility to prove it wasn't faulty or misdescribed at the time of sale. After the first 6 months and up to 6 years after purchase it is your responsibility to prove it was faulty at time of purchase to make a legal claim on this act. I can send this document to any one who posts their email address.

Hope this helps I'm still not sure if I'm going to purchase another warrenty or not but I'll look for one myself on the interweb.

 This is the reply I have had from Consumer Direct which deals with these problems instead of North Yorkshire Trading Standards. 

"I understand that you purchased a caravan from a local dealer which had a 5 year warranty issued by the manufacturer, who has since gone out of business.  In this circumstance, the guarantee is no longer valid as the company you would claim against no longer exists.  However, you do have rights against the dealer you bought the caravan from, if you have problems with the caravan within six years of purchase.

Under the Sale of Goods Act 1979 (as amended), all goods supplied by a trader to a consumer must be of a satisfactory quality, fit for their purposes, and as described.  If this is not the case, then you may have the right to reject the goods in question and ask for a refund.

The law states that you only have a short time in which to reject goods for a full refund, and once "acceptance" is deemed to have taken place, your rights will be limited in the first instance to claiming a repair, or possibly a replacement or partial refund. Unfortunately you are not able to request a specific remedy - you are entitled to the remedy which is most proportionate and which can be provided within a reasonable time.

It is entirely your decision whether or not to also buy an extended warranty.  It may be the case that the warranty offers additional benefits to those provided under the Sale of Goods Act 1979, and you would need to look into this fully.

It is not clear from your correspondence whether or not you currently have a problem with the caravan.  If you have, I would suggest that you call Consumer Direct on the telephone number below, in order that we may discuss your rights in more detail.

I trust the above information is of some assistance to you.  If you require any further information or clarification on this case please do not hesitate to contact Consumer Direct quoting your reference number.

It seems that if there are any problems within 6 years of purchase and they are the manufacturers fault, the dealer has to take responsibility.

I would think that taking out a warranty with the dealer is far too expensive considering what it actually covers.

Has anyone else had a quote elsewhere?
