Fact , in Australia it is illegal to drive in bare feet , period . They have done studies which show a high proportion of accidents may have been avoided if suitable footwear had been worn . Maybe a lot of Aussies blame the accident on a bare foot not gripping the brake pedal effectively in an emergency .
In England you would be prosecuted if you had an accident that could reasonably be blamed on bare feet not allowing you proper control of the vehicle .
Flip Flops are frowned upon because they are just that , flippy , floppy and do not allow firm contact at all times with the pedals . High heels do not allow full flexing of the ankle on the throttle but this does not usually come into braking as the whole foot is generally used . Flat shoes , trainers etc are considered best and sometimes insisted on by instructors and where I have taught female relatives to drive I have asked them to carry suitable driving shoes for use in the car and many years later they still swap from heels to flatties just for the comfort . You take your pick which is most sensible .

If you've ever had to brake hard in an emergency with no shoes on dam sure you'll ware shoes afterwards.

Coming back from a canoeing trip my shoes were soking and I just drove without and I had to perform an emergeny stop when a stray peice of metal was blown onto the road infront of me.

Moving quickly from the accelerator to the brake I cut my foot on the the side of the pedal and it was incredibly sore when having to press the pedal hard.

Shoes for me ALWAYS.

Cheers

Richard

oops, I drive in bare feet all the time,  also drive in flip flops, I hate wearing socks of any kind but don't like my feet to get sweaty especially if I am wearing trainers, so I just take them off when I get in the car,

My OH who is a bus driver went mental at me telling me I was breaking the law when she found out (i don't drive her, and happened to open the car door while she was on the drive,) so I asked her to prove to me it was illegal, so far she has failed too so unless I see hard evidence I can't then I will carry on. Feels perfectly safe to me

I've tried driving in bare feet, OK if the pedals are new, some old pedals can be so worn as to be razor sharp at the sides, especially if the rubbers are old too. Riding the motorbike was much less comfortable due to using the top of the foot as well as the bottom of the foot for gear changes. Also you soon learn to keep your toes up when cornering fast !!! Tarmac is like a belt sander at speed

I didn't know so many people would have an opinion on this, but as for not having control of the vehicle, thats ridiculous as its the control of you foot not whats on it, I could tie a fish to it and still have full control..........

Is it a fact?

Please provide a link to the legislation.

I am also not aware of any accidents in England that have been blamed on driving with bare feet. So I guess it is your supposition that you'd be prosecuted with 'driving without due care and attention' and that the prosecution would 'prove beyond reasonable doubt that the defendant was not exercising that degree of care and attention that a reasonable and prudent driver would exercise in the circumstances' by wearing flip flops or having bare feet.

I generally drive with shoes on, I dont like wearing flipflops and soft soled shoes as they can get caught/wedged under the pedal and you have to pull them out, but can't see any tangable reason why driving with no footwear would be an different to driving with footwear.

Possibly if you have foot problems a shoe could offer some support, but if you have no problems with your feet, I can't see any problem with it whatsoever.

Hello OliverDay ,

I lived in four different States of Australia over a 30 year period and had to obtain a permit to drive in each one , I was told in road knowledge classes in each of those States that inappropriate footwear and barefoot driving was illegal and could result in a fine . Needless to say , a huge amount of people drive barefoot , most younger people live in shorts and bare feet during the warmer months .

In certain parts of Spain it is illegal to drive in shoes without strap round the back. The local police follow hire car's as the most likely offenders.

Thank`s to OliverDay , I have done more digging into the Barefoot rules in Australia . The link below is old now but I have no reason to believe it has changed .Answers to the question from most Australian Governments start about half way through the page . It appears driving barefoot in Australia is not an absolute , it comes under Australian Road Rules 297 which are explained in part within the forum linked to . Some States have their own legislation to accompany this rule 297 . Examiners WILL NOT take you out for a test barefoot or in flip flops and this must be the rule they are relying on , effectively this has probably given rise to the common belief that barefoot driving is illegal in Australia . Sorry to present as fact something that is not . However , if you have the patience to read the posts linked to , police interpret the rule themselves and do issue tickets for driving barefoot .They are probably using Rule 297 or a similar State rule , so , it is probably better to err on the side of caution .
My comment that you would be prosecuted for driving barefoot in England clearly states that relates to having an accident that could be REASONABLY blamed on driving barefoot , the onus would always be on proving that fact , probably not too easy .

Sorry, but Australian legalities bear no relation to here in the UK. I have been able to find NO laws here or any previous cases that have even mentioned it.

Alan is right and you need to take on board all of the words he has used including "could be REASONABLY blamed on driving barefoot". There have been cases of drivers being prosecuted for driving without due care and attention, as they were bare footed. EG  (scroll down to the experience of humpbackmaniac).

You can also be prosecuted for the same offence for driving whilst drinking or eating a sandwich if it can be shown that you are not exercising proper control of the vehicle. Thus it is not illogical that driving bare footed can potentially lead to a prosecution if the facts support the case.

I know of a case of a woman with a veruka driving bare footed and she admitted that when she applied the brakes for an emergency stop the pain was such that she could only apply a light touch to the brake. So she didn't stop. The facts supported the case that she was not in sufficient control and should have worn protection for the infected foot.

These cases are few and far between, but the potential is there.

In many cases what we think isn't an offence, can be if wrapped up in another way. So you don't get charged with driving with bare feet as that is not an offence. You may be charged with driving without due care and attention.

You can be in complete control with bare feet of course.

Phil
