I think it is a very good law. Have you ever tried to move a trailer out of the way that does not have a jockey wheel attached? The regulation seems to specify any "trailer" rather than "unbraked trailer". i think if you challenged it in court you may lose.
As mentioned by another poster, why would one need to lift the caravan high to remove a jockey wheel as the jockey wheel is an assembly of two parts? You simply unwind it to split it into tow parts.

About two month ago my van came of tow ball due to me rushing luckly no damage was done due to the fact i was driving about 5 mph and my jocky wheel was still attached this saved damage to a frame.

We too have become detached due to being distracted when hitching up. The jockey wheel took all the brunt of it but only buckled. Although it needed replacing which we did the next day when we could get to a caravan dealer, it still worked well enough to manouvre and support our folding camper that first night.

I always remove my jockey wheel for transit. This since one dropped down.hit the road and destroyed itself on the M25.

A good thread.  I wonder about this, cos my jockey wheel will lmpinge on the ground because my drive onto the road is too steep.  So I have to fasten it fully retracted and outside the fibreglass housing, at a stupid angle.  What would happen if the van came off at speed is not good.  Might get dragged onto the other side of the road . . . . !!  OUCH
