Hi Michael,

For once two blokes from either side of the Pennines are in agreement.

This is a calamity waiting to happen.

If you insist on going ahead you could either do what Michael above suggests. ie get the van to your house. OR you could take an armful of anti theft devices to the van and install tyhem on it so that the keeper doesn't move it.

Having said that, our "friends" without a home have no trouble taking off anti theft devices in the twinkling of an eye.

I still wouldn't touch that van with yours.

For goodness sake, GETMEOUTOFHERE!!!!!!!!!!!!!!!!!!!!!!

Most people have offered varied replies with advice based on their experiences and understanding which I have found helpful.

So, If you have nothing constructive to say, don't bother posting.

I, Along with others have constuctive things to say ,mostly along with the majority, that the seller is selling something that is not his, if after all these comments you cannot grasp the fact, then that is your problem, a calamitous one it would seem to be, hence my previous post, have a good season! and happy camping.

My mum and dad had this problem with a car they bought a few years ago.  The owner didn't inform them which they wasn't happy about but still wanted the car so they went to the bank with the owner to check that she paid the money straight in so that the loan was paid back in full and all was well.  See they could be genuine people who fully intend to pay the loan back but don't have the funds until you pay, they might not be able to afford the payments anymore that is why they are selling it to recover the money left on the loan.

The main things is though it;s alot of money and a big purchase so you have to feel totally comfortable with what you end up doing.  you are the one buying noone else.  I wish you the all the best with whatever you decide to do

In answer to the original post:-

No, it don't think its worth the trouble.  There are plenty of good vans to be bought from honest private sellers.

Yes, I think you were being conned, as the seller didn't mention anything until you 'found him out'.  To my mind, this means that you cannot rely on this person to treat you with openness and honesty.

Many people have bought vans, only to find they are not quite what they seem - i.e. they have damp, delamination, botched repairs etc,.

What would be stopping you from finding another one to buy?

Hi Getmeoutofhere,

In that case the situation is clear.

The seller has no right to sell the goods.

The goods do not belong to him/them.

If you "buy" the good from the seller then you are not receiving "good title" for the goods. The goods still belong to the Hire Purchase Company.

By all means get yourself a barge pole, but, under no circumstances touch the caravan with it.

Partially correct but there is nothing stopping the transaction going ahead.  Perhaps the new purchaser could pay the finance company the outstanding balance and the remainder to the dellar.  I did not have a problem as there was no ways I could pay the outstanding balance.  The main thing is that the finance company should be made aware of the transaction and any issues surrounding it.

In addition what is the difference between selling your caravan with outstanding balance to a dealer and selling it privately.  Too many negatives here.

Maybe the sellar is in financial difficulty and was a bit embrassed about telling you that they needed your money to pay of the outstanding balance.  If you work in conjuction with the finance company I do not see a problem and pay by credit card.  That way you will be covered.

I am afraid that I must stick to my original post, in the past I have had trouble with seller's not forthcoming with the truth and once had a car "taken" in the middle of the night by a finance company because of outstanding finance on it that the seller "forgot" to inform me.

There are loads of genuine seller's out, you have to stand back and ask yourself do I need these problems??

Micky
