Oh dear yes i see now, I avoid them like the plague with the van but I have my dog insured with them because as the name suggests thats what they specialise in, maybe I ought to rethink.
I presume the amount on offer is for the caravan alone as it was badly damaged and written off.It is not unreasonable to assume that other equipment and accessories (Not personal effects)that are covered under the caravan section of the policy were damaged.It might be worth checking this out.
If you had Personal Effects cover for your belongings check if any loss or damage has occurred.
Your policy will tell you what is covered under each section this needs to be read and understood as this document is the legal contract which the insurance company is bound too as well as you!!
It is a fact of life that with claims it not always realised items that are missing until long after the event.

How are you doing with this one, Nichel? It seemed like a choice of accepting their offer or pushing further, possibly going to the Ombudsman. Sorry I can't advise on the best course of action, having never been through the process, but please let us know how things are going.
We're not sure what to do at the moment, been thinking about it all day. Is it worth pursuing and getting maybe a little bit more but taking goodness knows how long or cut our losses and accept the offer so we can get another caravan now. Heard a few horror stories about E and L now. For our next insurance we will do a lot more research.
I don't think we can make that decision. That has to be yours based on the strength of the supporting evidence you have as to the market value of a similar van. You are some £1500 apart at the moment. If you did not send a letter of the kind I suggested earlier then you cannot, at this stage, submit a claim to the Ombudsman. The response from E&L has left the door open for you to get back to them on their revised offer. Thus it is not a "deadlock" response.
If you do decide to reject their latest offer then you must write and ask for a deadlock letter indicating that you are to proceed to the ombudsman.
The issue of claiming for a lost holiday in August is not an insurance claim (as they suggest). It is a claim in damages for breach of contract. That is to say, they have failed to compensate you in accordance with your contract of insurance (if the ombudsman agrees with you) and as a result it has taken so long to resolve that you have lost that holiday.
An appeal will take time and you will lose that holiday. If you have anything booked for September then you may also lose that. If your evidence of the market value of similar vans (preferably what they have actually been sold for) is of sufficient weight then the ombudsman will lean towards you. Whether he will go the full £1500 is possibly doubtful. If he splits the difference then you gain £750 but will have lost the holidays.
It's perhaps time to weigh in the balance the fight, the risk, the gain, the loss. Then what really matters.
Then change your insurers and ask E&L for the balance of any annual premium back for the balance of your insurance term.

Once again an excellent article and advice from Phil.
It has been stated that the Glasses guide book price is £6975 I would be surprised to see any settlement given by the Ombudsman to be above above this amount without very strong evidence to justify it.
With some insurance companies you may still lose out even if you can prove that you are right!!
I do not think E&L will give you a refund for the balance of your insurance term.
In my previous experience (not with a caravan - a car) if it is a total loss and the insurance company pays out - even if the incident was in the first week the policy is taken out you would have to start again with a new policy.
There's usually a clause saying that if there's a claim(for write offs) then any premium monies owed must be paid, obviously this is for people who pay monthly/installments. I don't think a refund would be possible.
The name of the insurer says it all. Phil's advice is correct and it is time to fight back and it will be a long uphill battle against these **um but with FOS on your side you may stand a chance.

Still waiting to hear from E&L after receiving an email from them asking us what we wanted to do as they had not heard from us, even thought their automated response had sent us an email saying they'd received ours. Absolutely rubbish company!!
On a good note though, our very good friends have lent us the insurance money(minimum they'll pay) and having put money towards it we are now the proud owners of a Lunar Delta 640 and will be able to go to the South of France on Wednesday with said very good friends

Interesting that they have more or less split the difference between their first offer and the Glass guide price. On a practical issue if you went to the Ombudsman I reckon that you may not get half the difference again, masybe less than £200 and sometimes its just better to get sorted and move on.............and change insurers
