I feel so sorry for you in your predicament.
I think you need to consider how long you intend to keep the caravan. Yes it means disappointment for this year if you reject it and hold out for a replacement or your money back. If you accept the offer of a repair will you feel the same about the caravan and always feel slight niggling doubts which in the long term will spoil your enjoyment of the caravan?
Personally I would always feel the caravan was tainted.
As a separate issue why should you put up with this treatment? For my part I would instruct your solicitors to sue.
I do appreciate that this is easier for me to offer advice because I am not experiencing the problem you have, not only the caravan but the disappointment both you and your family are experiencing. What should have been such an exciting time for you and your family has turned into a nightmare. Both the dealer and manufacturer should be ashamed of themselves.

I wouldn't accept a repair. If you have given notice then you need to follow it up or the dealer will know it was an empty threat. Forget about Swift, your contract is with the dealer, take them to court you will win but you need to issue court papers now.

The sales of goods act will cover you,its the law. research it and know your rights your caravan is not fit for purpose. speak to CAB if unsure.

Thanks everyone, yes i am aware of my rights but i'm convinced the dealer wont offer a replacement so i will have to get a refund. That will take time which means all plans for this year have gone out the window. I have spent so much money already and even took my b+e test ready.

Iv'e tried pleading this with the dealer but they are as cold as ice

I think you should get the support of the CAB and consumer agencies. The reverse burden of proof part of the sales of goods act will help you.I understand you know your rights but you need support.

This is why swift have constructed a defect repair / the build facility at their factory . According to a friend in the trade who visited it last year it's HUGE !! Because they are getting so many vans returned !!

As other posters have said ,take it back ,replace it now or threaten legal action and also trading standards,local rag ,websites like this.
Sadly you have to go in all guns blazing and don't back down.
Also try and get there when there are potential customers there ,no one likes a raging customer when they are just about to sell another one.
That is a disgrace!.
If you are in a union or ,motoring club you will probably be entitled to free legal representation.

So it's confirmed (finally after 3 weeks) the dealer won't replace the van so the finance company has agreed a full refund.

Although I’m happy to get a refund I’m bitterly disappointed that my holidays have now been wasted for this year and this was mainly due to the dealer purposely dragging this out longer than it should have.

For those interested the dealer is South Hereford Motorcaravan Centre. I would seriously consider anyone looking to invest this sort of money on a leisure vehicle to avoid this company all together.

Thanks for all your help everyone, this experience has not put me off but taught me a valuable lesson for next time!

I am sorry ,I would not leave it there,would take them to small claims court for loss of holidays .
Me being who I am would do all I could to damage them,
I would spend my proposed holiday (I am retired though) handing out fliers to everyone that went in there.The only way to hurt these people is through their pocket,try and get a local TV slot on you and your kids disappointment ,local consumer programmes would love it. Newspapers. I would try and bury the b''''''ds, sadly these days it is all they know.
Very sorry for you and your children ,makes my blood boil reading this.
If you want to sue them in High Court ,start a fund on here I guarantee you twenty quid if you do.Go for it boy ,will make them all sit up and perhaps realise they cannot bugger up peoples lives when they have spent their life savings on a sub standard bit of garbage..

Many on here would have been following this thread and I for one am glad to see you have got your money back. No one would blame you for just walking away, thats your call. Out of interest what happens now, the finance company will want to recover their money I guess? or do they take ownership of the van, will they think twice about offering finance to this company?

I hope so!

In all fairness to the finance company they were very good and it's not their fault there were issues with the van. This would have been sorted out sooner if it weren’t for the dealer saying the problems didn't warrant a rejection (although Swift wanted it back at the factory for 4-6 weeks), this prompted the finance company to arrange an independent inspection which took time. However, the findings were clear it was not of satisfactory quality.

I did make a point to the finance company about the PDI check which I believe was never carried out and I was willing to prove that. If that was done/done properly then we wouldn’t be in this position today so I hope they take that on board.

But surely Black Horse deals with these issues everyday?

As you quite rightly say Alan, it is a very sobering thought if Matlitel had paid cash he would be right up to his neck in the proverbial now.
What a disgusting way to treat people ,I just hope they get to enjoy some holiday this year with a view to looking forward next year to a pristine new van.
All very sad.
