Have not answered him, I have looked over my ad it seems cut and dried. I had a few texts asking if it was free of damp and as far as I was aware it was.I think I would have noticed it myself having used it regularly. I haven't been untruthful to the buyer in any wa. Will wait it out and see what happens next I think. I don't have a copy of the receipt he requested as I saw no need to.
This is my ad if anyone would like to see.I had same on Gumtree but removed it at the sites request because it sold
just out of interest where did the person that bought it come from? I would keep an eye open for your van reappearing very shortly on any of the selling sites
It looks a lovely van and you threw in lots of extras...all for £950.
I don't think he has a leg to stand on. He should have had a damp test done. Damp doesn't show up on many vans so you sold it in good faith.
Taking into account the extras he had I think he did all right.
when a van gets to that age its unreasonable to expect it to be in perfect condition.. in fact damp is more likely to be present than not and short of pulling things apart its not possible to check a vans true condition..
no dealer would offer a guaranty with a van of that age and at that price..
it unreasonable to expect anyone to.. the person is trying it on but dosnt have a hope in hell of doing anything other than intimidating you into coughing up..
he ether knows this or is a little on the dumb side.. i go for the first option.. :)
I had exactly the same problem with a car i sold, i was threatened with solicitors and allsorts, so i called the OFT and they told me that writing sold as seen has no legal standing at all, but as long as it was as described in your advertisement then their is nothing they can do, my buyer also took it for a test drive left a deposit and came back a few days later to collect the car with his mother, they were still completely happy until later that afternoon he set his mother on me who stated it had a tapping noise coming from under the bonnet, all which was told to him and advertised prior to the sale, the point is as long as you described it honestly their is absolutely nothing they can do.
Some years ago when I was looking for a caravan I always asked the seller if there was any damp. Nobody said 'yes' but I got lots of non-committal answers like, 'Not as far as I know', and, 'Not the last time I looked'. One person said, 'I put my clothes in the front underbed lockers and they are never damp'. All the caravans I looked at had damp.
Eventually I got a, 'Definitely not...I check regularly'. That was the caravan I bought
The only tjing he can get you on is if you have mis described it in your original advert. Did your original advert say it was damp free, irespective of you believing it to be, if you advertised in writing as damp free then it would need to be and a court may go in his favour because it isn't. If you didnt mention in your advert about damp then he doesnt have a claim, its all about the wording of the add im afraid.
