Oh my god some people are unbelievable!

For those that haven't read my previous posts i'll give a quick recap....

I bid on a van on ebay and the guy said he was selling for a friend. I rang the guy and said i was going to bid but if its not as described i'm not taking it. He said yes thats fair enough. I paid to have it checked with cris and hubby lost half a days wages and diesal money from Bristol to Portsmouth.

The van was advertised as needing some tlc and the guy said its all there working just needs a good clean. I arrived to find the whole floor was bouncy and it was rusty underneith. It was in a terrible state with numerous things wrong with it.

There was an Indian guy with him ( you'll see the relevence in a bit as to why i'm stating his race)

I told the guy i wasn't going to buy it and went home. I then left him negative feedback because i didnt want anyone else going down and wasting their time, also i wanted it recorded that the caravan was bad incase ebay tried to chase me for the money.

Last night we had a phonecall at 9pm with a whole torrent of vile language and threats to come up our house (ebay gives out your address to sellers)

He said i was a rascist because i didn't talk to him. It all clicked with my hubby and he said oh i see you were the guy stood there and its your bloody van is it!! He said "yea  and my ebay account that you've messed with, your going to pay for this, yea you've got a shiny new van (our vivaro) it wont be anymore, i've got family in bristol i come up to see and i'm coming down your house!"

Well we wouldn't have thought much of this but we remembered the other guy mentioning before we viewed the van that he had family in bristol so we knew he wasn't lying.

As you can imagine this really shook me up. I emailed him and said he has to put himself in my shoses and how would he feel if he was put out of pocket chasing after a van that was not as described!  He then replied this morning and said "you bid you won so you buy. I will see you in court to recover the cost of the van, you won it its yours!

I think you need to report it to the police, trading standards and e-bay.

It sounds really horrible; it would have really upset me too.

You certainly need to report the abusive call to the police and get a reference number.
The police may even be able to give you details of how to stop calls from this person.

i would def log it with the police, I would report it to ebay as soon as possible also with copies of his emails to you.

His van was not as described so paypal etc would be on your side and I would imagine ebay would be as well but threats to you and your property are not on so call your local police station.

Hi, I would speak to Ebay and advise them of the problems, but more also the abusive phone call, if you are concerned, speak to your local police station, as threatening behavior shouldn't be tolerated, at least if nothing else they will have our report on record, incase the said person does it to anyone else.
Some Ebay sellers are really sh***y, and think they can get away with conning genuine buyers, but as you said, the item was not as described then you'll have Ebay's full backing.

Hi, this is my view of what you may want to consider doing.

Firstly,threatening and abusive phone calls are a criminal offence and may also amount to harrassment.
Report it to the police and they will be able to trace the call,gather the appropriate evidence and will deal with the offender. You may however have to give evidence at a criminal court.
Keep a log of all calls and copies of all correspondence. If possible have someone listen in on the calls.

Secondly, do not worry about civil court action, the chances of it getting that far is extremely unlikely. The fact that the van was not as described was an attempt con you, you also had a verbal agreement which allowed you to remove your offer based on viewing and accepting that the description was correct.

Thirdly If you can, complain to ebay.

I know exactly where your all coming from and i have spoken to my friend who is a policeman. He thinks the guys just full of hot air and peeved that no one else will buy it now. He said they hear a lot of stories about threats to do with ebay and 90% of the time the threats are idol.

I don't really want to push this any further because i've come across these sort of people before and i wouldn't put it past them to cause me real trouble if they get in trouble. they are the sort that would just send someone else up my house and put a brick through the window!

I'm just going to let him think the last email frightened me and hopefully that should be enough for the bullying parasite!

If i hear from ebay i will just tell them it was described as a 6 berth and turned out to be a 4 which is true and also the general state of it. I'm too scared to mention the abuse on the phone incase they get him off ebay and then i've really peed him off!

My wife has a business that also sells via ebay, most of the people are genuine but you do get some bad apples, she's quite lucky as its home baking stuff she sells and people looking for that tend to be "normal"!!

 If your senses are telling you something aint right then walk away, like you did. Us honest sellers get treated badly by buyers too, we have two cases at the moment where someone has bought then decided to do a "chargeback" this means paypal reverse the payment to the buyer even though we have sent the item etc! This can be done if one of the seller rules is broken, even something as simple as sending to another address that paypal dont have on the system is breaking the rules, this can be innocent, like "my mums wants it, can you post it to her" but can be a way to create a chargeback and they get the item for free...very annoying.

Anyway..enough of my rants! Get onto ebay as mentioned, also go on your ebay account and cancel the bid, or just let ebay do it for you, he will be miffed as he has lost a sale also if the bid isn't cancelled he'll have his ebay fees to pay too which amount to quite a lot for something that costs a bit, I say tough, he should have decribed it correctly.

Hi sproz we we only saw the caravan 45 minutes before the end of auction. I rang to say look its obviously too late too view it before biddng but if i win and its not as described im not parting with my cash. He said yea thats fine.(of course he said that, it wasn't his blooming account!) well i won the bids so yes the real account holder will have to pay the fees, but then again he wont pay much because i didn't take it off his hands. I think he'll just get charged the insertion fees?

I've written an email to ebay explaining things and then didn't send it because im too scared of what he'll do if i pee him off any more. The guy was a psycho nutcase on the phone, he wouldn't let my hubby get a word in edgeways!

I've spoken to the police now and they have given me a crime reference number incase anything comes of it. She offered to contact the portsmouth police to find him, but i said no i don't want any more trouble and that i just want them to have the threat on file incase anything does happen. I felt a bit silly really because she said the police aren't interested in what goes on in ebay. I said i can appreciate that but this guys actually rang my home phone and has my address! She said i should contact ebay and get him chucked off so he can't con anyone else. I'm just going to wait and see what happens now and if ebay to contact me i can say look this has been logged with the police so its my proof he's a nasty peice of work.

You have done the right thing, I wouldn't worry about him 'visiting', someone like that won't even know where Bristol is!! never mind have a vehicle in a fit enough state to get there!!!

Make sure you contact ebay, that will stop him from doing this to others, also if they wipe off your details/address from his files i bet he hasn't printed anything out to be able to find you.

He recited our address so yep he does know where we are, plus his ex wife lives here which his friend had already mentioned before any of this kicked off. I appreciate you trying to make me feel better though 17

I've just been on the phone to my brother who knew a lot of bad people in his younger yrs and he said people that mean it don't say it they just do it. he thinks he's all talk. I do feel a lot better now for talking about it and hearing everyones views, so thanks for all who replied. How mad eh? All i wanted was a caravan for my family lol.

Surely if the item you were thinking of buying is NOT as described, you have every right to walk away & not go ahead with the deal. After all, he's the one who isn't keeping his end of the bargain not you!!

I an understand you feeling upset & concerned by his threats to visit you next time he calls on relatives in bristol but I doubt he'll bother.

What I would do is support of your reprot to the police is, write down everything you remember was said & who said it to who. This may be vital to your defence should he pursue you for the comletion of the deal.

I'd call ebays legal department on the phone & ask them what you're expected to do. They may have the means to lift your feedback from his account.

There are a few nutters round but I think your brother is right, nasty little creeps. At least the police have it on file but its all proof isnt it!! Bet you got a right shock!!
