Surfer01 the fitting of older than new tyres happened to a friend of mine with a Coachman Pastiche, bought brand new just under £16,000. When the van went in at 2 years and 10 months old for it`s service he was advised that the tyres should be renewed as they were 5 years old. How many caravanners not knowing about age codes having blow outs at when their van is 4 or 5 years old, but as you say not illegal for makers to fit them.
