i wrote a question a few months ago re towing out off storage at a well known caravan park in Devon, it now transpires that this well known site has now issued letters to all caravaners who store at their site stating,"your own personell caravan insurance covers the caravan being in the storage space, out on site and during tows. great care is taken during the tow in and out service by our ground staff however in the event of any accidental damage this will need to be claimed upon through your own insurance. it is a risk you take when you request us to move the caravan on your behalf, please make sure you provide a new photo copy of the insurance schedual when it renewed annually". my question is if our van is damaged would our insurance be void because we are not towing our van to our pitch if any damage was caused by them, we also pay a tow out fee of £18 for this service.

If it were mine I think I would be contacting my insurers with a copy of the caravan park's letter seeking confirmation and clarity. It would be invaluable in the event of a claim.

I would be interested in the answer. I know CC sites that store vans and put them on a pitch for their owners. I wonder if CC Insurance would cover this sort of thing then.
you could ask your insurance to question there rules and regulations before any damage.possibly tell them and not you.they are insured and have a duty of care under there policy.

They are providing a service and so have to comply with the requirements of the Supply of Goods and Services Act in that they must use reasonable skill and care in moving your van. If they cause damage to your van then there is a potential argument that they have failed to comply with the Act and are liable.
What they are endeavouring to do is to incorporate into your contract a clause that no matter what happens it is your fault and that you will claim from your insurers. Now, that has to comply with the requirements of the Unfair Contract Terms Act in that such a clause has to be resonable. They would probably fail to meet the standards required by the Act and so are liable.
What will happen in practice is that you will claim from your insurers and your insurers will then claim from them.
The advice given above that you should check with your insuers that they are happy with such a contractual clause is pretty sound advice. If your insurers are not happy then find somewhere elese for your van

Our storage site owner will not allow anyone other than him to tow on or off the storage site in case other vans are damaged. The owner stated to us that if he damages a van he pays for the cost of repairs through his insurance.
many thanks for your responses, they will allow us to tow the van out ourselves, but when we stored the van at this site, we down sized our car to a smaller engine size thinking we would not require to tow our van anymore, but now, thinking of buying a car that would tow our van, but it would be added cost to us.

update from my post, for anyone who has their caravan stored at this well known caravan park near, starcross in devon. i received an e-mail from my insurance broker who informs me that, policies for caravan insurance only cover the insurer or immidiate family to tow your van, if there was a accident or damaged to any van towed by their staff, then our insurance becomes nul and void, if the park are offering a tow out service then they should have liability insurance to cover them for any damaged caused by them, if they do not have this insurance then what they are doing is wrong. many thanks for your replies.

Good advice and exactly what I would have stated as they are supplying a service for which you have paid. Many storage places think if they insert this type of clause they can opt out of any responsibility. It could be termed and Unfair Clause under Consumer Regulations.
I totally agree with Phil, check your paperwork ( contract agreement )with the storage company and if they have a get out clause go to Trading Standards and seek thier advice as I think like Phil they are in breech of the Supply of Goods and Services Act
I would be worried even more if everyone started towing their own vans out.
Caravans maybe parked fairly close and damage may not get reported. People may not be very good at parking their vans. Partly why they chose a site that tows on and off?

There is a storage site in Brean that charges you £45 per month storage and every time they tow the caravan out they charge £3.50 and when they tow it back in, another £3.50!
