Whilst the highway code states that it is not an offence to park on the footpath it could be a civil wrong. “Offence” denoting a criminal act. It is an offence to park on the pavement if the vehicle is causing an obstruction. The Police could take action
On 31 March 2008 Regulations came into force under Part 6 of the Traffic Management Act 2004. These brought in Civil Parking Enforcement by Local Authorities and listed a whole raft of civil wrongs in terms of parking for which penalty charges could be issued. The Local Authority can add to that list and many have included the parking with one or more wheels on the footpath.(£70 charge). There should be a notice in the street where such a “civil wrong” has been adopted.
In the Greater London area these matters are regulated by S15 Greater London Council (General Powers) Act 1974 – again these are adoptive provisions.
