I would say there was shared blame between guy using your van and the vehicle joining the carriageway. The seemingly only innocent party is the van who "rear ended" your van.

The whole incident sounds like it could have been avoided by the guy driving your van simply slowing and letting in the "idiot" joining the A38  who would then have been off and away into the distance no doubt

Not at all, he must have seen the vehicle coming up the slip rd & also the vehicle in the nearside lane & yet he assumed that either of those 2 other vehicles would slow down & give way to the other one, he made no allowance for the scenario that actually happened that he should have anticipated. All he had to do was back off slightly & there would have been no accident.

As I said "seemingly" - none of us know the full details. If the van was already up level with the Transit there would have been very little in real world he could have done differently.

Some slip roads appear quickly and are pretty short so not always possible to anticapate - but this sis all guess work anyway

jon is right about forward planning, however if you can't move over, and sometimes you can't, then the onus is on the traffic joining the carriageway to give way, not to force traffic on the carriageway to brake, if I find myself in this situation I use the horn, it's not failed yet

If there were vehicles in the left hand lane (which was the case, a Transit) then he may not have been able to see the slip road.

What is failed to be mentioned here is whether the driver of the Transit used his right indicator to let the driver in the middle lane know he was actually going to make a right manouvre as corrective action could have been sought by all to avoid a collision. Mirror.. Signal.. Manoeuvre is all well and good, but If after checking the mirror, you see another vehicle coming, the process should be halted. It shouldn't be Mirror... Signal... Manoeuvre... CRASH!

When I was learning to drive, I was taught that if another vehicle would need to slow to make room for your manoeuvre then you shouldn't be making the manoeuvre.
