When we ordered our new van at the NEC in Feb we were told we would have it by the middle of May at the latest, probably not for thisBH week-end. We thought that was acceptable and signed on the dotted line. Now we are told it is not going to be ready until the latter part of June.
Reading the contract the expected date of delivery just says tbc.
I’m annoyed as I have seen other dealers with the van in their possession. We would have gone to a different dealer if we’d known!
How long would you be prepared to wait for a new van? I’d love to get my deposit back and go and buy the van and get a whole summer out of it,
We don’t take leave during school holidays as we let colleagues with children take those weeks. Our main trips are all before July!
------------- Started with a motorbike and tent.......my gallery, my life.
The other dealers you have seen the van at, is it a demonstrator?
------------- XVI yes?
As well is two words!
How does a sage know everything about everything? or does he? or does he just think he does?
Remember, if you buy something you bought it, not brought it.
We had a similar problem. We ordered our van at the NEC in October and were promised delivery in late January or early February. In mid January I phoned the dealer to see if they had an exact date for us yet, only to be told the van wouldn't be arriving until June! I nearly had a conniption! I was told all sorts of rubbish about dealer specials being manufactured before standard models but the distinct impression we got was that somehow in the busyness of the NEC they has taken our deposit but forgotten to order the van. I remained very outwardly calm (unusual for me) and told them I would get back to them shortly. I then phoned round a few other dealers and found one who was expecting a delivery of a couple of the model we wanted in February and hadn't sold them all yet so could save us one. I then phoned our dealer back, told them that June was not acceptable, showed them a photo of the receipt we had from the NEC that said February, told them we had sourced the caravan from elsewhere for February delivery and asked for a refund of our deposit. They said they would get back to me shortly and about 2 hours later phoned me back to say that they were able to get us the van by February after all as they had negotiated with Swift who had been able to reorganise vans going to different dealers to get one to our dealer a bit earlier. I was a bit dubious but accepted this and things worked out fine, we got it mid February!
Our Bailey dealer has a number of production slots with dates allocated to him. We ordered our new van in Jan and were give a firm delivery of early Feb. We booked the hand over date and time there and then.
It was there as agreed. They only had a number of these slots available and we had the last but one.
Does the fact it's ordered at the NEC change the contract law as it is not from the dealers normal place of business. It's distance selling I believe.

I think that the dealers take deposits as "non refundable" on the basis that they are at the NEC regularly and therefore it is not covered under the distance selling legislation.

That is correct however if delviery is promised i.e. Feb and then you are told June at a later date, you should be able to get back a full refund.
I was told at the NEC show in February that delivery of a Bailey caravan I was interested in would be middle of June, it was off the same dealer I had my last caravan off. I called in another dealer a little nearer to me in March got a better deal and it arrived second week of April. Just shows the difference between dealers.
