Hi all, I have just purchased my first caravan, a Bailey Pageant Provence 2005 from friends for £4000. When I viewed it they said that they had just had a leak from the roof but that it was now sealed and fixed. After purchasing the van and moving everything in, I opened all the windows on a hot day to find that they were falling in. The whole front was literally falling in in bits as the wood was totally rotten. The side window was starting to do the same and the seals were caving in. My friends never mentioned this to me but did say that they would repair it. I had a full service done on it as they never towed it and it showed that the tyres are out of date in 3 months time, the battery is dead, the brakes have fallen off, the handbrake doesn't work and cannot be towed as it is dangerous! Finally my friend has fixed the front window after fobbing me off once already but not the side window or anything else. I asked for my money back but he said no, it is a 15 year old van. I expect things to be wrong with a 15 year old van, like the pump keeps stopping and starting, a few fly screens are out, tarnished bits and bobs and general wear and tear but I did expect it to be at least road worthy and did not expect to have to shell out approx another £1000 to get it on the road and the window and damp fixed (which is 70% by the way). Am I being unreasonable? Any advice would be appreciated.

With friends like that I wouldn`t like to meet your enemies.....
Sadly, it`s a case of `buyer beware`, it sounds like the caravan wasn`t `advertised` as such so there is probably no source of redress in law. If the damp is as bad as you say, then hopefully you are a pretty competent DIY-er as a professional repair will in all likelihood cost more than the purchase price of the van.
Your `friend` has knowingly sold you what is in effect a worthless shed. There is no way he/she could not have been aware that the van had galloping rot to that extent.

I know and thanks. I am absolutely devastated but am a single mum with a deaf and autistic son so dont have time for big diy projects. When in life do you think it's not ok to trust what you think is a good friend for nearly 20 years? Hells teeth. Thanks for replying.

One of the “joys” of caravanning is the constant battle against water ingress. Not so bad if you can store it in a barn, but when outside all year in all weathers then leaks are inevitable with age. The key is to check for damp regularly and fix problems asap when they occur. Unfortunately if left unresolved the damp turns into rot and becomes more involved to fix.

The good news is that the materials to repair it are not that expensive and there is loads of information on this site. Professional damp repair tends to be uneconomical because of the number of hours, but it’s very reasonable as a DIY project over a few weekends, even if you need to buy some tools as part of the job.

Having no experience with caravans previously or what to look for prior to the purchase, don't you think it would have been a wise decision to have an independent inspection conducted first and acted on the results?
At least that would have been more cost effective in the long term when you were informed how much rectification work needed doing.

Yes of course and in retrospect I am acutely aware of that but this was a very close friend of nearly 20 years and I thought I could trust them. Idiot I know. Thanks all.

Does either your houshold or car insurance include a legal advice service. If so, it may be worth having a word. Or citizens advice, maybe.

I do feel very sorry for you. It was clearly a con trick on a friend.

It's amazing how many so called good friends can play dirty tricks on you. A couple of times I have loaned things out to friends or family only to find out that it's broke when returned and only found out when I came to use it myself. They then claim that it was okay when they gave it back so it's money out of my pocket to replace the damaged goods. A lesson learned not to trust anyone no matter how long you have known them as there a lot of dishonest people out there. I'm glad to say that I can hold my head high and say that I'm not one of them!

I would talk to citizens advice and let your 'friend' know that is what you're doing and that you're looking at the small claims court. Might push them into helping out with the £1000k. Have you friends in common what have they got to say ?

Unfortunately with a private sale you only have redress to the law if it can be proved that the seller deliberately misrepresented what they were selling. If you have say an advertisement for caravan stating it was in first class condition etc then possibly you might have recourse but if caravan looked ok when you bought it then probably not.

If the caravan is so bad that it is beyond economic repair then you might have a case because it is unusable & never will be. Tell your ex friend that you intend to get an engineers report & that if they do not refund you will take them to small claims court. The threat could be enough.

Buying a used vehicle from a friend is the quickest way of destroying a friendship known to man.

So sorry to hear this has happened. I don't know how some people sleep at night.

As others have said, your rights are severely restricted if you buy from a private seller. Unless they have actually lied, you don't really have any comeback.... https://www.which.co.uk/consumer-rights/advice/your-rights-when-buying-second-hand-goods#did-you-buy-it-from-a-private-seller

Looks like, unfortunately, deliberately concealing does not appear to equate to lying!

Might be worth checking if you have any legal insurance through your car, home or caravan insurance and having a word with them if you do have any evidence that they lied about anything.

I cannot see £1000 fixing all that has been highlighted. The battery is a notional £100 for a start. It must be riddled with damp/rot all over. These people most certainly aren't 'friends'. They have to have known how bad things were. Its a shame the service wasn't done before money changed hands. You have been well and truly suckered by people you trusted. I am not sure what redress you have outside 'sending the boys round'.
