Hi I sold our tourer 11 days ago it is in perfect condition they came to see it and bought it their and then. My issue is when we bought it 10 years ago we got told it was a 2005 model we never checked this over the years tbh having to many great holidays with our kids. So when I advertised it I had put it was a 2005. They have messaged last night saying they got pulled in a site asking what year it was and apparently they guy checked it on site and told them it's a 2000 model. Now I never knowingly put it up as 2005 if its a 2000. They have had it 11 days taken it 100 odd miles away on holiday and apparently been told they can't stay on the park with it cause of its age and they want their money back. Just looking for a bit of advice please. I am a genuinely honest person and have been worried sick about this all day. What do I do please help 😢

That is ridiculous. I have never known any site turn away a tourer for being too old. My tourer is a 1992 model and no site has ever said anything about it. Sounds to me your buyer is trying to pull a fast one!

the only reason i can think of ,is, the buyer wants to put the van on a seasonal / static pitch, and the site has an age proviso, get the van back and give them their money ,less any use they have had out of it , thats up to you.

Yeah they were apparently putting it on till end of season but i have never heard of anyone being turned away plus the van is in excellent condition inside and out. And we have been to loads over the year

They bought it "sold as seen" just as you did 10 years ago

and you have maintained it well for ten years! good on you !

Do you still have the Vin number ? That is number on chassis plate & etched into windows. Post it up on here. Age of caravan can be identified from vin number.

Or post up picture of caravan. Difference between 2000 & 2005 model should be obvious to anybody that knows.

One of the few reasons a private sale can be disputed is misrepresentation & possibly this could be disputed as that so you need to establish age of caravan beyond doubt which needs Vin number.

IMO If the van was misrepresented in the advert or ensuing discussion then the buyer has cause to claim the money back. Whether that misrepresentation was innocent or intended IMO will make no difference, if indeed it was mis sold.

That the buyer was told by a site owner of its age or found out any other way is of no consequence to you, in that it does not alter the facts here.

Best get to know the van's correct age, if its age was involved in any way during the sale.
If you misrepresented it then speak to Citizen's Advice for more solid legal guidance, but IMO you will need to accommodate the buyer if they seriously want to push things.

CRIS numbers started in 1992 so the caravan should have them on the windows. If you still have the CRIS certificate and not passed it on to the buyer, you can check it's year of manufacture.

Take it back minus £500 for their use of, then resell for more than you sold it, crazy prices at moment for caravans. Could make £3000 on our 2010 Bailey that we bought in 2019, if we wanted to sell, mad.

If you advertised it as a 2005 model and it is actually a 2000 model then it is 'not as advertised' and the buyer may have a claim. Too late now but perhaps you should have advertised it as 'believed to be a 2005 model but bought as seen'.

However, just because the buyer says a site owner has said it is a 2000 model is just hearsay and would not be admissible in a court. The buyer needs to provide some documentary evidence that it is genuinely a 2000 model.

My advice would be to throw the ball back in their court. Be honest with them and tell them that you honestly believed it to be a 2005 model but that you cannot accept just a verbal opinion of a site owner and that you will need to see some documentary evidence that 'proves' the caravan is a 2000 model beyond doubt...otherwise, their opinion is no better than yours.

Don't forget that it would be very easy for someone to buy a caravan and have a good holiday in it, then try to get their money back by suggesting there is something wrong with it or not as advertised. The onus is on them to prove it...innocent until proven guilty - lol.

Let them do all the work and if they cannot prove it, tell them to take a running jump (nicely) - lol.

Although there is the Misrepresentative Act which is very hard to prove in some cases, by the same token the buyer had ample opportunity to check the CRIS number which is etched onto every window.
I think that if you said that you will take back the caravan less £500 they may out of spite cause £500 damage so be very careful. Is there a big difference in price between a 2000 caravan and a 2005 of the same model and what are the differences?
Never heard of any site owner refusing a caravan on a seasonal site because of age. Ask them the name of the site so you can contact the site. It would be interesting to know of they give you the name of the site.

In my opinion, and only my opinion.
I would be giving the money for the van back and a huge apology. for selling something that's NOT as described.

A van advertised as 2005, then to find out its actually five yers older, surely is worth a lot less.
Maybe not you'r intensions to con anyone, however Its just not night right I say.

Before I gave any money back I would make sure of the age of the van,if it is indeed a 2000 and not a 2005 then I would refund the money.

If it was me that sold it to you Kevin you would not be getting a penny back without a fight. In all probability there would be little difference in value between a 15 year old caravan and a 20 year old one anyway, at that sort of age condition is everything. It is likely in fact that a 20 year old caravan in excellent condition is actually worth more than a 15 year old one in average condition. Age is largely irrelevant at anything much over 10 years old, in my opinion.

I think these new owners are trying to pull a fast one. As others have said, anything newer than 1992 has CRIS markings on the windows, and the buyer would have had ample opportunity to check on the age. I certainly would have done. It is quite likely that they DID check the age when they looked at the caravan and saw it as an opportunity to have a holiday with it then get their money back. If they wanted their money back I would make them fight for it, through the courts if necessary.

When I bought my caravan, from a dealer, I was told that it was a 1994 model, but when I checked it was actually a 1992. I wasn't bothered in the least and never said a word. It simply didn't matter. The difference in value would have been insignificant, and I'd got the caravan that suited us perfectly at a price I could afford, and that was all that mattered.

I would agree with you Colin, a van that age is sold on condition really.
Not being an expert I don't the legalities!
Depends if the buyers are prepared to go to court if the refund is refused. Tricky area, especially in a private sale.

I doubt if they would try court if it came to the push. TBH they are probably chancers. If they had said that they found out that it is 5 years old and want a partial refund I can understand. They were otherwise happy with their purchase when they checked it over.
